Magufuli and Social Media- Is Jamii Forums Africa’s WikiLeaks?

Followers of Tanzanian politics would have noticed that digital activist and the co-founder of Jamii Forums , one of Africa’s most popular social media platforms was recently charged with managing a domain not registered in Tanzania, obstruction of investigations and refusal to provide data to police under the country’s Cyber Crimes Act 2015 . The charges, seen by many as suspicious, had the president’s staunchest supporters scramble to come to his defence. The subsequent #FreeMaxenceMelo viral campaign saw the hashtag trending at number one for three consecutive days. There were reports of crowdfunding campaigns for Mr Melo’s legal fees and many showed up at his court appearance where he was released on bail. This was not armchair activism!  Nonetheless, the irony is that, Mr Magufulis’s regional and global popularity is in part courtesy of social media; the very platform that it is believed he is trying to suppress. Further, the president’s popularity is also due to his determination in fighting graft, reducing government’s waste and excess and restoring work ethics within the public sector. Jamii Forums work tirelessly to defend freedom of expression especially on social media and is renowned for unearthing some of the country’s biggest corruption scandals. It therefore would seem natural for the government to work in tandem with it not against it as platforms like Jamii Forums are part of the solution not the problem.

Moreover, to Tanzanians, Jamii Forums is more than a ‘whistleblowing website’ as reported by some western media. Jamii Forum is neither Africa’s WikiLeaks nor Maxence Melo ‘African’ Julian Assange. Such parallels are disingenuous and may inadvertently feed into imperialistic view of the Global South. While it is true that Jamii Forums does provide a safe platform for ‘whistle-blowers’, the two are structurally and optically different. Jamii Forums is a virtual public sphere where discussions pertaining politics, education, entrepreneurship, health, security, and celebrity gossips too, take place. Provided one is registered and adheres to the site’s terms and conditions , anyone can start a thread and provide commentary on anything. Devoid of the visual distractions of Facebook and Instagram and the brevity of Twitter- the only thing that matters within Jamii Forums is one’s opinion- whether one is a primary school leaver or a PhD holder. In essence, Jamii Forums is a virtual home for Tanzanians where substantive and casual conversations take place- without the need to be ‘friends’ or ‘follow’ anyone.

Optically, Melo’s Jamii Forums works diligently to adhere to the laws of the land. Mr Melo is cautious and polite to a fault. He painfully avoids attributing his recent arraignment and harassments to what many believe to be orchestrated government’s efforts to intimidate and silence them. He is against the ‘oppressive system’ not the government, he insists! Unsurprisingly, #FreeMaxenceMelo wasn’t just about a person or necessarily political. It was a coalescence of people exercising their constitutional right to freedom of expression to protect free speech- to speak and write what they like! Sadly, it appears that a large percentage of the public does not view #FreeMaxenceMelo as the first instance of stifling of free speech in the country. Since Mr Magufuli inauguration, many believe there has been a noticeable shrinking of civic space. Granted that he was not the architect of the controversial Cybercrime Act 2015, it appears that he is vigorously implementing the Act. Additionally, he has approved what is viewed by many as an equally controversial bill, the Media Services Bill 2016 .

Global academics need to take note of a quintessential example of ordinary people leveraging locally incubated social media platforms to affect change. The milestones may lack the fanfare of Arab Spring or a western celebrity but they are no less significant. There is an acute realization across the continent that the future does not lie in Washington, London, Paris or Geneva. It is predicated upon what is happening in Kinshasa, Bujumbura, Accra, Banjul, Addis Ababa and Dar-es-Salaam. They want to be active participants and their countries would be better served by encouraging and not suppressing their participation.

JamiiForums: Meet East Africa’s Homegrown Social Media Network

Branded as the East African version of Wikileaks, JamiiForums has earned its place as Tanzania’s top social networking site.

In this guide, you will learn about JamiiForums and all the challenges the owners have experienced under the hand of the government.

What Is JamiiForums?

Jamii Forums

JamiiForums is an online social networking website where users can discuss various topics. Made of more than one jamii forum, users can visit the forum of their interest to look for work, discuss politics, lifestyle, celebrities, and comedy. Furthermore, the platform contains forums for other East African nations like Kenya and Uganda.

Maxence Melo and Mike Mushi launched the forum in 2006 as JamboForums. In 2008, the owners changed the name because of copyright issues. 

As its name suggests, the forum owners created a community for Tanzanians to network. For a while, the forum was conducive for whistleblowing. However, government regulations forced the forum to review what users post more strictly.

The main language of communication on the forum is Swahili. However, the descriptions of most of the sub-forums are in English.   

Government Censorship of JamiiForums

JammiiForum

Initially, JamiiForums acted as a tool that revealed corruption matters in Tanzania and advocated for political accountability. The forum made such a huge impact that the government declared “war” on the platform. As a result, Melo has been in court 137 times over the last three years. He has also been detained overnight over the same period, according to the BBC . Melo is the CEO and Co-Founder of the platform.

For instance, the police arrested Melo for alleged terrorism in 2008. Nevertheless, the charges were dropped. In 2016, the founders of the forum were charged with failure to comply with a disclosure order contrary to the regulations of the Cyber Crime Act 2015. They were also charged with managing a domain not registered in Tanzania. The government asked the founders to disclose the IP addresses, phone numbers, and email addresses of users that had exposed corruption in the oil and banking industries, which they declined.

On the bright side, Melo received an International Press Freedom award in 2019 for the journalism work he has done through the forum.

The Tanzanian government has used the Cyber Crime Law and the Electronic and Postal Communications Act 2010 to censor criticism. These laws have affected other media outlets, as well. For example, the government suspended five newspapers and two radio stations in 2018 for a period running between three to 36 months.

The Shutdown

In 2018, the forum remained closed for 21 days. The reason for the shutdown was the failure to comply with regulations to reveal users’ information and a delay in paying registration fees.

The shutdown made the founders rethink their method of conducting operations. For example, Jamii Media, the company behind the forum, hired 18 lawyers and more editors to review and fact-check all contributions before publishing them.

“Initially, people were free. You could do a little kind of editing of the comments they post on the forum. You could [make a] call to some civil servants and even politicians, and they could comment on something. But at the moment, such possibilities are no longer available,” Melo told the BBC.

Despite the changes the forum has had to make and the declining media freedom , JamiiForums continues to respect the privacy of its users. For example, Jamii Media uses its lawyers to assure contributors of their safety and privacy when the government bashes them for their posts.

Additionally, Melo is still keen to use the forum as a tool for change. He challenges the government to work with forums like his and other critics to fight corruption.

How to Use JamiiForums

To enjoy the complete JamiiForums experience, you need to register an account. Below are the steps you should take.

  • Visit the website
  • From the top tab, click “Register”
  • Enter your username, email address, and password. Alternatively, you can register using Google, Facebook, Yahoo, or Microsoft

JamiiForums

Once you register, you will have to wait for an administrator to approve your account. While your account is pending approval, you cannot post on the forum. However, you can read posts from other users.

Forum members earn trophy points for participating on the platform. For instance, you will earn 20 trophy points when you post your first message, and you will get 25 trophy points if your content attracts 100 likes.

To use the forum, browse through the different sub-forums to read what other members are posting. Also, follow the community guidelines once you are eligible to share content. Some of these guidelines include:

  • Being polite when using the forum
  • Using proper grammar when posting on the forum. The forum administrators encourage members to edit their content before posting it
  • Adding a link to your contribution when necessary
  • Refraining from spamming or harassing other members
  • The platform prohibits hateful speech

Privacy Policy

In light of the government-censorship on online forums, JamiiForums has published a privacy policy that highlights several significant matters.

Firstly, the platform no longer logs the IP addresses of its users. However, the forum collects details like usernames, email addresses, and the devices and browsers members are using.

Secondly, the company states: “In order to prevent unauthorised access or disclosure, we have put in place suitable measures and procedures to safeguard and secure the information that we collect.”

Thirdly, Jamii Media allows users to request a copy of their personal data. This shows that the platform is transparent and ready to protect the identity of its users.

Freedom on JamiiForums

Scrolling through several threads on the 2020 elections sub-forum, it is clear that regulations have not interfered with the freedom of expression. However, whistleblowing content on the forum appears non-existent.

That said, Melo is unsure what direction press freedom will take in the country.

“It is a challenging time for us; it is a challenging time for the sector. Everyone is worried about what might happen in the upcoming elections,” he told the BBC earlier in 2020.

Kwa mujibu wa Maxence Melo, Mwasisi-mwenza na mmiliki-mwenza, Jamii Forums imetokana na Jambo Forums iliyokuwa na majukwaa madogo mengi ya mtandaoni kama vile Tanzania Economic Forums, Habari Tanzania, Uchaguzi Tanzania, Jambo Network, Jambo Redio na Jambo Video.

Kusudio kuu la kuanzisha Jamii Forums, kwa mujibu wa Melo, ni kuunda jukwaa ambapo jamii ya kitanzania inaweza kushiriki kwenye mjadala huru kuhusu masuala mbalimbali yanayojitokeza kama vile ya kijamii kisiasa, kiuchumi na ripoti za habari zinazotokea hivi punde.

Kulingana na utafiti wa GeoPoll kuhusu matumizi ya mitandao, uliyodhaminiwa MCT, Jamii Forums ni tovuti ya kwanza kwa habari yenye XX.XXX % ya hadhira. Kwa mujibu wa Alexa Traffic, ni ya tano miongoni mwa mitandao ya kijamii nchini (Oktoba, 2018). Taarifa ya Kituo cha Sheria na Haki za Binadamu (LHRC) inasema kwamba, mtandao huo una watumiaji 2.4 milioni,walipiaji wa simu za mkononk 2.8 milioni na takribani watu 600,000 wanaotumia mtandao huu wa kijamii kila siku, mwezi Agosti 2017.

Maudhui ya Jamii Forums yanashughulikia habari za kawaida na hutoa fursa ya majadiliano ya masuala mbalimbali ya kijamii, kiuchumi, kisiasa, michezo na burudani. Licha ya kwenye blog hii, habari zipo kwenye Google Play, Instagram, Facebook, Twitter @Jamii Forums, pamoja na Youtube.

Mwezi Juni 2018, Jamii Forums ilifungiwa kutokana na wamiliki wake kuchelewa kulipa ada ya usajili kwa Mamlaka ya Mawasiliano Tanzania (TCRA) iliyotakiwa kulipwa kulingana na kanuni mpya ya maudhui ya mtandaoni (Online Internet Regulation). Kwa mujibu wa kanuni hii mpya, wamiliki wa blog/majukwaa ya mtandaoni wana wajibu wa kulipa hadi Tsh 2.1 milioni, pamoja na Tsh 1 milioni kwa ada ya Leseni ya awali kabla ya kuanza kuendesha forums zao. Wanatakiwa pia wataje taarifa za wanahisa wao, uraia wao na mtaji wa hisa.

Kanuni hiyo pia inawataka wamiliki wa blog na waendeshaji wa Forums kujisajili TCRA, kuhakikisha kuwa maoni yanayotolewa na wasomaji wa blog, watumiaji wa Forums ni ya wastani kabla ya kuchapishwa. Aidha wanatakiwa pia kubainisha chanzo cha maudhui.

Melo alieleza kuwa vyombo vya habari kuhusu kufungiwa huko:”Tumelengwa kwa sababu Forum yetu ni mtoa huduma na si mtoa maudhui, kwa hiyo tuliamua kufunga kwa sababu hatuna nafasi yoyote (kwenye kanuni za maudhui ya mtandao)”.

Mwezi Julai 2018, TCRA ilitoa Online Content Services Licence kwa Jamii Forums kwa hiyo iliendelea kutoa huduma baada ya kutimiza matakwa ya kanuni hiyo.

JamiiForums, an organisation advocating for digital rights and democracy, has launched phase three of the Stories of Change Competition to encourage citizens to participate in shaping their government, institutions, and leaders.

JamiiForums, which also manages the JamiiForums.com platform, which is famous worldwide for Swahili content, has been running this kind of competition since 2021, where participants not only win some amount of money but also contribute to the nation by providing diverse ideas. 

For this year, the winning amount is Sh20 million. Nonetheless, for 2023, the focus has been on good governance and accountability.

It is not just the prize, but making an impact on the nation by giving ideas that will mark the grounds of strong institutions, which is amongst the issue that plays a significant role in development.

Good governance and accountability are essential principles for the effective functioning of any country. Good governance refers to the government’s transparent, accountable, and participatory management of public resources and decision-making processes. 

At the same time, accountability ensures that those in positions of authority are responsible and answerable for their actions and decisions.

The Tanzanian government has improved governance and accountability, including implementing reforms to enhance transparency, combat corruption, and promote citizen participation in decision-making processes. 

Citizen participation is where JamiiForums gives a chance for inclusivity for every citizen to participate in making changes to the country.

Towards more accountability

For a long time, JamiiForums.com has shaped information processing in the country. Citizens on the platform actively report events quickly and engage in meaningful discussions. 

Various leaders, including President Samia Suluhu Hassan, have acknowledged surfing JamiiForums to get to know the ideas people discuss online.

The impact that JamiiForums has created from the daily discussions that reach over three million people daily is not to be ignored. However, neither do Stories of Change competition undermine the impact but accentuates the influence.

Addressing the press in JamiiForums office recently, the organisation’s Executive Director Maxence Melo said for this year, the state actors have agreed to give special attention to the Stories of Change so that they take what can be implemented.

A double impact, that is, a participant in the competition, does not only get the likelihood to win money but is guaranteed to get ideas implemented.

Melo said the previous phase of the competition took place from July to September 2022, with 1,820 citizens participating and submitting 2,073 entries, of which 1,462 were approved. 

The top ten winners were awarded various prizes at an event held in Dar es Salaam in November 2022. The Minister of Information, Communication & ICT, Nape Nnauye, was among the guests on the day of awarding prizes to winners. 

Her Excellency, Samia Suluhu, is expected to be the guest of honour in this year’s awarding ceremony.

The Tanzanian Government has pledged , to its citizens and the international community alike, its dedication to enhancing democratic governance. 

Most scholars have shown how digitalisation helps in enhancing democratic processes. Araba Sey and Michelle Fellows have presented a compelling argument that digital and internet technologies can revolutionise how information is accessed, and citizen participation in policymaking can be enhanced. 

JamiiForums has taken that opportunity to enhance by providing an online platform and running a competition that calls for specific focus areas.

Bridging the digital divide

Knowing that the whole process of the participation of citizens in this competition requires an internet connection, it is a call for the government in Tanzania to address the problem of the digital divide, which has been a discussion in the digital economy.

The data from Tanzania Communications Regulatory Authority (TCRA) shows that the number of internet subscribers in Tanzania has been steadily increasing at an average rate of 17 per cent per year.

In 2018, there were 23,808,942 subscribers, and by the end of 2022, the number had risen to 31,172,544 subscribers. However, the population census shows Tanzania has almost 61 million people, meaning nearly 50 per cent of Tanzanians are disconnected.

The digital divide, which refers to the gap between those with access to digital technologies and those without, has significant implications in many areas, such as education, politics, health, and job opportunities. 

It can lead to social stratification and economic exclusion and hinder economic development in developing countries. On the other hand, satellite internet services like Starlink have the potential to bridge the connectivity gap in rural areas with limited traditional infrastructure and fuel growth in various sectors. 

Companies like OneWeb, HughesNet, Viasat, and Amazon’s Project Kuiper offer similar services. As a result, they could contribute to bridging the digital divide.

From the Stories of Change, Tanzania can see the need to embrace digital infrastructures and establish digital tax policies to promote inclusive economic development and social inclusion through improved access to digital technologies.
