You've misunderstood the travel history refusal. Ideally CIC is looking for previous travel to countries requiring visas such as the US and UK. The travel history refusal means that one of the reasons why you are being refused is because you haven't previously traveled to a country such as this. Based on that, I'm not sure you've included the right explanation in your letter. Similarly the purpose of visit refusal can refer to a lot more than just your planned studies. This can often mean that you didn't demonstrate sufficient ties to your home country and IRCC has concerns you have plans to remain in Canada long term.

I have realized that in order to engage in challenging projects for data analytics, I need to undertake graduate studies and build upon my knowledge. There is a considerable overlap between Mathematics and Computer Science, especially when dealing with data analytics. Cheriton School of Computer Science offers several courses that incorporate this overlap very well. My sole purpose of visiting Canada is to attend University of Waterloo for this program. I wish to learn advanced computer science subjects specializing in data analytics as it will help me expand my knowledge & expertise in this field. I also wish to interact with the pioneers of this field at University of Waterloo, and learn from their experience. Upon completion of my program in Canada, I wish to return to my family in India and pursue a career in data analytics. India is an emerging data analytics hub for both private and government organizations. This field holds immense potential for professionals with an advanced skillset in data analytics. A graduate degree from University of Waterloo coupled with two years of work experience in India, will help me pursue a challenging career at research and development departments related to data analytics in India. This refers to your application for a temporary resident visa to Canada. I have completed my assessment of your application and I have determined that you do not meet the requirements for a temporary resident visa; therefore, your application is refused.

In accordance with section 11(1) of the Immigration and Refugee Protection Act (IRPA), any person wishing to become a temporary resident of Canada must satisfy a visa officer that he or she is not inadmissible to Canada and meets the requirements of the Act . This includes the requirement to establish to the satisfaction of the visa officer that the applicant will respect their conditions of entry and will leave Canada by the end of the period authorized for his or her stay.

In reaching a decision, an officer considers several factors. These may include the applicant's travel and identity documents, reason for travel to Canada, contacts in Canada, financial means for the trip, ties to the country of residence (including immigration status, employment and family ties) and whether the applicant would be likely to leave Canada at the end of his/her authorized stay.

Guide to re-applying after a visa rejection

Generic refusal letter from IRCC

Visa applicants often look for advice on how to overcome a refused visa application; in some cases even two or more refusals. You might be wondering why someone would wait to ask for advice after receiving a refusal or why they would make repeated unsuccessful applications expecting a different result.

This frequently occurs when there is a lack of understanding about the visa application process and how an initial application might have been deficient. Below are some tips you may find helpful to get your application approved if you are planning on re-applying for a visa.

If you have ever had a visa to Canada refused or know someone who has, you are probably familiar with these words found at the end of a refusal letter:

You are welcome to reapply if you feel that you can respond to the concerns that are listed in the letter

Applicants are often genuinely surprised to learn that their application was refused and are anxious to act on this instruction to re-apply as quickly as possible. This is not advisable and can be a big mistake. Submitting several applications over a short period of time can severely hurt your chances of ever being approved for a visa!

Unclear reasons for visa refusal

After being refused a visa, the most common mistake applicants make is to re-apply without fully understanding the reasons why they were refused in the first place. IRCC refusal letters are generic template letters that offer only general reasons for the refusal and no substantive information.

If you have received a generic refusal letter and do not understand the specific concerns of the visa officer, it may be worthwhile to delay any further application until you can learn more so that your next application can address the visa officers’ concerns.

It is essential that you obtain the notes of the officer who refused your application in order to properly understand the reasons for the rejection. That way you will have access to the detailed reasons for the refusal and can address the visa officers’ concerns in a subsequent application.

The officers’ notes can be accessed by requesting the Global Case Management System or “GCMS” notes. These notes cannot be changed once they are entered into the GCMS system, and they offer the most insight into what the officer was thinking when refusing the application.

You can see a sample GCMS file  here  and the most important and interesting part of the file is usually at the very end in the Notes section. It is here that the immigration officers’ observations and reasoning for decisions made are noted. Such notes are easy to understand and you don’t need to pay someone to help you understand your GCMS notes .

What do refusal reasons by an officer look like?

The notes made by an officer in GCMS notes vary; in some cases it can be a few sentences long and in some cases it can be a page long or several pages long. As noted in a Federal Court decision ; “ Visa Officers face a deluge of applications, and their reasons do not need to be lengthy or detailed . However, their reasons do need to set out the key elements of the Officer’s line of analysis and be responsive to the core of the claimant’s submissions on the most relevant points.”

Re-applying takes more effort

When re-applying for a visa that has already been refused it’s always advisable to supply more information instead of less, but you want to also lookout to make sure that any new information you provide is consistent with past application materials . If you don’t have access to all the information that was submitted with your prior application you can request that from IRCC or CBSA by ordering the Entire File . The Entire File includes copies of all the documents from your prior visa application PLUS the GCMS notes.

Since applicants are too focused on resolving the particular reasons for the initial rejection rather than strengthening the overall application, many applicants make the mistake of presenting less or even contradictory details in a subsequent application.

This approach is not correct since each new application is evaluated on its own merits. Moreover, it’s unlikely that the visa officer who refused your prior application will also review the subsequent application.

As a result, it is not unusual for a first application to be denied for one set of reasons while a second or subsequent application is denied for another set of reasons. It is the applicant’s responsibility to ensure that each application submitted is accurate, complete and provides all the relevant information necessary for a visa officer to approve the application. A visa officer is under no obligation to tell you what information you need to submit in order to be approved.

As noted in a  Federal Court decision ; “The onus is on the Applicant to satisfy the Officer that they meet the requirements of the law that applies to consideration of student visas, including that they will leave at the end of their authorized stay.”

If your visa application has been refused multiple times, it is advisable to obtain the GCMS notes for each refusal. Ordering the GCMS notes multiple times has no negative impact. See the official response from IRCC

Preparation is the key to success

Applicants frequently wonder what sort of documents they need to submit to support their visa application. They often do not see the value of providing corroborating documents because they believe that some facts about their case are obvious and wonder why a visa officer would not just believe them when they say something. Sometimes applicants think that certain matters are private and do not need to be explained.

What is apparent to you might not be obvious to a visa officer who has never met you and is only familiar with your paperwork. When you can back up your claims with independent, corroborating evidence, they become even more convincing. Similarly, most claims would have more weight and credibility if they include as much information as possible.

There is never any guarantee that a subsequent application for a visa or permit is going to be successful. Conversely, simply because you’ve been refused before doesn’t mean you’ll not achieve success if you re-apply. Preparation is the key to success. Before re-applying for a visa you have to make sure that you understand the explanations for the initial refusal and gather additional supporting documents to reply to the visa officer’s concerns. In the re-application process, you need to ensure that all your new information is consistent with prior application materials and make sure that you provide sufficient details to make your case for why you meet the criteria for your application to be approved. That is why GCMS notes and Entire File are essential to successfully re-applying.

Case notes in Global Case Management System

According to IRCC; the visa officer should ensure that case notes in Global Case Management System (GCMS) are complete and accurate. The officer should do all of the following:

  • outline the circumstances of the application
  • outline the process followed in coming to or making the decision
  • note the presence and identity of an interpreter, if applicable
  • take into account any representations made by interested persons (or counsel) and make note of the nature and content of these representations
  • detail the reasons for the refusal

Note:  Refused applicants may seek redress from the Federal Court of Canada and the Canadian Human Rights Commission . If applicants choose this recourse, officers will have to provide their notes.

What is Application for Leave and Judicial Review (JR)?

An individual who has received a decision from IRCC, and who thinks that an error was made in that decision, can generally apply to the Federal Court of Canada and ask that the Court review the decision. Making an application to the Court for a review of the decision is called an Application for Leave and Judicial Review . A review means that the Court will read the decision and decide whether an error was made or not. If you are considering applying for Judicial Review (JR) then it is important to review the GCMS notes first and then determine whether an error was made in the decision from IRCC. GCMS notes are more than just a refusal letter, they contain the officers’ detailed reasons for the decision. The strength of a JR depends on the strength of the underlying visa application , so it’s important to have in possession copies of all the supporting documents submitted along with your application. If for any reason you don’t have these documents then the Entire File can be requested which will include the GCMS notes + copies of all the supporting documents.

Reconsideration for visa and immigration application refusals in Canada

Request for reconsideration

Sambath, a Cambodian citizen, applied for a study permit in Canada. He believed his application was perfect and addressed all the immigration officer ’s questions. However, an officer refused the application based on a missing Letter of Admission (LOA). Ironically, Sambath had enclosed a valid LOA from a Designated Learning Institution ( DLI ). He booked an appointment with an RCIC and asked him to request reconsideration for the study permit refusal. The RCIC agrees to assist Sambath.

What does constitute reconsideration, the potential outcomes of a reconsideration request, what is “functus officio”, the legal basis for reconsideration requests, how to submit a reconsideration request, let us help.

If an immigration officer refuses an application , you may ask them to reconsider the decision. However, you may not place a request just because you disagree with the officer’s decision. You have to include enough information and documents to show the officer one or more of the following has occurred:

  • The officer has made a clerical error (e.g., they did not notice a document).
  • There are humanitarian and compassionate reasons to reconsider the decision.
  • You have detected an obvious mistake in fact or law
  • The complementary evidence you have found could convince the officer to change their mind

As mentioned earlier, you may have different reasons for filing a reconsideration letter. Regardless, you may see different results, such as:

  • Reopening of the application and requesting supporting or updated forms and documents
  • Approving the application
  • Refusing the request and keeping the application closed
  • Disregarding the request and leaving it unanswered

Of course, the last two bullet points have the same outcome. However, the latter is harsher as the officer completely ignores your request. It also opens the door for filing a judicial review .

Before continuing this article, I have to explain the doctrine of functus officio ( pronounced ˈfəŋk-təs-ə-ˈfi-shē-ō). The principle implies that if a decision-maker renders a decision, they may not take it back.

According to Canada (Citizenship and Immigration) v. Kurukkal, 2010 FCA 230 (CanLII) , the doctrine of functus officio does not preclude the immigration officers from reconsidering their decisions. However, the Federal Court of Appeal fell short of providing a list of circumstances the officer must reconsider their decisions. Following this decision, IRCC has issued a set of Program Delivery Instructions to assist the immigration officers in reconsidering H&C applications . Here is a brief list of those factors:

  • Officers failed the principles of procedural fairness and natural justice
  • The applicant has pointed out a clerical or other error
  • New evidence has emerged that is reliable and material

Some other factors could negatively affect the requests, namely:

  • The evidence was available at the time of the original application
  • There is a significant time lag between the refusal and the application for reconsideration
  • The officer suspects misrepresentation in the initial application or the subsequent request
  • The federal court has already refused a judicial review application

These guidelines are for H&C applications. However, they could assist us with other types of applications.

In most cases, you could submit the request via the IRCC webform . Nonetheless, if the officer has communicated with you through email, you could also contact them by email. However, ensure the email address is correct and will reach the decision-maker. When you are submitting the request, consider the following:

  • Be courteous to the immigration officer.
  • Be clear about your request.
  • Explain why you believe you deserve reconsideration
  • Present any documents that support your request
  • Refer to the potential Humanitarian and Compassionate elements of your request (e.g. the hardship you are facing and the best interests of a child affected by the decision of the officer)

Step 1: File your Notice of Appeal​

To start your appeal, send the following documents to the Immigration Appeal Division (IAD):

  • a completed Notice of Appeal form , and
  • a copy of the refusal letter that the IRCC sent to your family member

You may also send additional documents which you think can help resolve your appeal.​ For example, if your refusal letter says your application was refused because you did not provide a specific document and you have it now, you can send it with the Notice of Appeal.

30-day deadline

You have 30 days from the date your family member received the IRCC refusal letter to file your Notice of Appeal.

It is important to keep all contact information up to date. Use the Notification of Client Contact Information form to tell the IAD if it changes. If you or your counsel do not respond to a communication from the IAD, the IAD can dismiss your appeal or declare it abandoned. This would mean that your appeal is over and the original decision that you are challenging does not change.

Representation at the IAD

Extra help with the process for children and people with mental health concerns.

You or your counsel must tell the IAD if:

  • you are under 18 years of age, or
  • you are 18 or older but not able to understand what your hearing is about

The IAD can then appoint a designated representative for you. A designated representative is not the same as a counsel. A designated representative is a person who is responsible for making decisions in your best interests. They will also explain the hearing process to you.

Extra help with the process for vulnerable persons

Some people need special help with the appeal process because they:

  • have gone through trauma
  • have a physical or mental illness
  • are older and frail or ill, and this is causing trouble with understanding or taking part in the process

A person in this situation is called a vulnerable person. If you or your counsel think that you may be a vulnerable person, contact the IAD office that is dealing with your case. You will find the contact information in all letters from the IAD. You may receive accommodations, including changes in procedures.

How do I get help if my visa application is refused?

There is no formal appeal process if your application for a temporary resident visa is refused.

Should you wish to re-apply, you should do so only if your situation has changed substantively or you have significant new information to submit.

New entry requirement now in effect

Visa-exempt foreign nationals need an Electronic Travel Authorization (eTA) to fly to or transit through Canada by air. Exceptions include U.S. citizens and travellers with a valid Canadian visa. Canadian citizens, including dual citizens , and Canadian permanent residents cannot apply for an eTA.

In order to study in Canada , the majority of foreign nationals require a study permit . The issuance of study permits is approved at the discretion of Canadian immigration officers. Unfortunately, it is common for a study permit to be refused to a foreign national for a variety of reasons. In the event that a study permit is refused, a visa officer will issue the refusal in a letter outlining the grounds for refusal.

If a foreign national is refused a study permit by Immigration, Refugees and Citizenship Canada (IRCC), there are two courses of action for addressing the refusal:

  • Appeal the decision: If the applicant believes that their application met all requirements as mandated by IRCC, but the study permit was refused unfairly or incorrectly, the foreign national can appeal the decision and request a reconsideration.
  • Submit a new application: If the applicant believes that the grounds for refusal are valid, then their only course of action is to submit a new application. In the new application they should pay careful attention to address the previous grounds for refusal. As well, if any documents need to be updated (start date on acceptance letter, updated bank statements, etc.) the applicant should be sure to obtain these updates.

What to do if Your Application is Refused

When a study permit application is refused, this refusal will be noted in a letter issued by the visa officer to the unsuccessful applicant. Within this letter, the visa officer will indicate the reason(s) for refusal from a list of pre-determined possibilities. This listing of refusal reasons gives only basic information regarding the grounds for the refusal.

However, when an application is refused, the applicant has the right to request the visa officer’s notes supporting the reason for refusal . It is strongly recommended that these notes are requested as this will inform the applicant as to how best to address the refusal. Once an applicant has obtained the case notes from the visa officer, they can assess whether or not the grounds for the refusal were valid. If the study permit was refused for valid reasons, for example, if the applicant failed to include any of the required documents, then the best option is to submit a new application after ensuring that the errors are addressed.

If the study permit was refused for reasons the applicant believes were invalid then an appeal requesting reconsideration may be submitted. Both the appeal process and the resubmission process may take considerable amounts of time. The applicant should therefore be prepared to contact their school to request amendments to their intended start date in the event that they will not be able to obtain a study permit in time to begin the program on the date originally planned.

Reasons for Refusal

There are many reasons why a Canadian study permit application may be refused. These reasons will be indicated on the refusal letter issued by IRCC. A foreign national may also request case notes from the visa officer who reviewed their file in order to better understand the grounds for refusal. Below are the most common reasons why a study permit may be refused:

1. IRCC Questions Your Proof of Financial Support When you submit a study permit application , you need to demonstrate that you have sufficient funds to support yourself in Canada. IRCC mandates that all international students prove they have the funds to cover their tuition fees for the first year of study, as well as the cost of living for themselves and any accompanying family members.

How do you address a problem with proof of financial support? If your application is refused because IRCC questions your ability to financially support yourself, you should carefully review the financial documents you submitted with your application. Make sure that you address the concerns raised by the visa officer and submit additional documents to prove that you meet the proof of funds requirement.

2. IRCC Questions Your Intention to Leave the Country A study permit is a temporary visa, which means that it has a validity period and an expiration date. In your study permit application , you need to convince the visa officer that you will leave the country when your study permit expires. That does not mean that you cannot apply to extend your study permit , or stay permanently . In fact, there are many programs designed by the government to help students stay and work in Canada following their studies, or transition to permanent residence. What it does mean is that the visa officer has to trust that you will not stay in the country illegally when you are out of status. Usually, this is a problem if you don’t demonstrate that you have good reasons to want to return home.

How to address a problem of intent? The best way to address this concern is through your personal statement. If the visa officer isn’t convinced of the narrative you’ve provided, you need to rework your statement to try to address their concerns directly. Note: It is possible to actively pursue both permanent and temporary residence in Canada. This is done by claiming dual intent in an application.

3. IRCC Questions Your Choice of Study Program Study permit applications are sometimes refused if the visa officer doesn’t understand the logic of your choice of program or level of study . Someone with a Bachelor’s Degree in Nursing from the Philippines and four years of experience working as a nurse who wants to study hotel management, for example, could be questioned. The chosen program in Canada doesn’t seem to align very well with the applicant’s educational background or employment history.

How to address a problem with choice of program? If your choice of program seems odd, given your past education or work experience, you need to clearly explain why you want to study it in your personal statement. This is another case where seeing the visa officer’s notes can really help.

4. IRCC Questions Your Acceptance Letter Before you can apply for a study permit, you have to obtain a letter of acceptance from a Designated Learning Institution (DLI) in Canada. You also have to meet all program requirements. If the visa officer doubts that your letter of acceptance is genuine, or that you have actually met the program requirements, they might refuse your study permit.

How to address a problem with an acceptance letter? Review the school documents that you submitted. Make sure that all of the documents are clear and easy to read, and provide any additional supporting documents that you can. In some events, you may want to contact the DLI that issued the document for help addressing the officer’s concerns.

5. IRCC Questions Your Travel or Identity Documents If you don’t have a complete record of your travel history, or if your identity documents are unclear, IRCC may refuse your study permit application. IRCC must be able to verify your identity to determine whether you are medically or criminally inadmissible to Canada.

How to address problems with travel or identity documents? If the visa officer thinks there are blank spaces in your travel history, review the documents you submitted and the visa officer’s notes to find which time periods are problematic. When you re-apply, be sure to include additional supporting evidence to cover these periods. If the problem is with your identity documents, review your application to make sure that they were clear and easy to read.

It must include:

  • The letter must contain your personal details like name, surname, passport number, date and place of birth, full address, and phone number.

Paragraph 3: 

Here, you can elaborate on your arguments and explain why the embassy should reverse its decision. Your claims should be backed with facts and based on valid grounds. Your tone should be convincing.  

In the end, you can mention the date of your trip. This can help in creating a sense of urgency.

Supporting Documents

To make your appeal stronger, you should always submit supporting documents alongside your letter. These documents depend on and vary according to the reasons why your application was rejected.  

Depending on that, you need to submit documents that can prove that the embassy’s reason and decision for denying your entry to their country are wrong.

  • Unclear Purpose of Visit: Submit the documents containing proof of the flight tickets you booked and a letter of invitation written by an institution or a friend in which they explain your purpose of visit. Dear Sir/Madam,

Please allow me to introduce myself as Amarjeet Singh, a citizen of India and a resident of the United Arab Emirates. I have been living in the UAE for seven years now and have been serving the Human Resource and Administration Department of National Life & General Insurance Company SAOG in the capacity of an Assistant Manager. In accordance with the labor laws of the UAE, all employees are entitled to one month of paid leave annually. I had saved my annual leave to this day and I am now looking forward to availing it by visiting my dear wife who is currently in Canada on a study visa. My wife, Jasmeet Kaur, is currently enrolled in a two-year MBA program at University Canada West, which is set for completion in 2023. She left for Canada in <month, year> and I miss her terribly. I want to visit her and spend some quality time with her. However, as I applied for a visitor visa, my application was refused on the following ground:

  • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your family ties in Canada and in your country of residence.

I assure you that I am a genuine temporary entrant, wanting to go to Canada to visit my wife.

Being a Human Resource professional, I am responsible for a host of tasks such as recruitment and training, payroll management, policy development, grievance resolution, and resource management. At this time of the year, the period from mid-October to November is an ideal window for me to spend time with my wife; as after that, I will be engaged in winding up all the year-end activities and will be entitled to the next month-long leave only after April 2022. Therefore, this is the perfect opportunity for me to be with her. My current employer has approved my leave and will be expecting me to resume work from November 16 onwards. Therefore, I do not plan to stay beyond the authorized period, i.e. October 15 – November 14, 2021 and will be returning to UAE, my country of residence.

Family ties in Canada

In Canada, my wife is my only tie. I do not have any friends or relatives residing in Canada, and hence I will be staying with Jasmeet at her residence: <mention the address>. If given the chance to travel to Canada, I want to be with my wife and explore nearby attractions with her. Vancouver, British Columbia is a popular tourist spot and is known to house some of the most iconic places such as Stanley Park, Vancouver Aquarium, and VanDusen Botanical Garden. I plan to take a tour of this beautiful city and spend quality time with Meenakshi. Seeing her after a long time will be therapeutic for me as I have been missing her.

Incentives to return to the UAE

In the UAE, Jasmeet and I have been flourishing professionally. While Meenakshi has had six years’ worth of work experience in the hotel management industry, I have been working in the country for seven years and have been promoted four times throughout my trajectory at National Life & General Insurance Company SAOG. Both of us have been doing well on a professional front and have had stable jobs. Upon the completion of her MBA program, Jasmeet will be returning to the UAE and will be applying for jobs in our country of residence. Neither Jasmeet nor I have plans to settle in Canada as I will be returning on 15th November 2021 and my wife will be returning in 2023 soon after completing her graduate studies.

In the long run, we plan to settle permanently in India, our homeland. In India, we have immovable properties that need to be taken care of, and we also have strong ties to our family. My mother lives in India and though she comes to visit us in Dubai, she is on her own and also has emotional and medical needs. Since there is no one to take care of her, it is my responsibility to extend her the support that she needs. Therefore, we will be returning to India ultimately.

Financial status

As I put forth my request to visit Jasmeet in Canada, I assure you that I am financially sound and will be managing my own expenses while in Canada. I have more than sufficient funds to comfortably stay in Canada and will not be a burden on my wife. I have total funds amounting to CAD 40,901.26 in the form of savings. The proof of finances has been attached alongside this application for your kind perusal.

I hereby state that I am fully aware of the Canadian Rules for visitors and I assure you that I will abide by those during my stay in the country. Also, I am fully vaccinated against Covid-19 and have attached my vaccination certificate for your reference. I request you kindly process my application and allow me to travel to Canada.
