Fees and Payments – PCT System

Types of pct fees.

During the international phase, PCT fees are generally payable:

  • to the receiving Offices (ROs) ; and, where applicable
  • to the International Preliminary Examining Authorities (IPEAs) (under Chapter II).

The amounts and currencies of the main PCT fees vary depending on the RO and IPEA chosen as well as on the International Searching Authority (ISA) specified for the search and may be subject to certain reductions, where applicable.

There are basically three types of fees payable to the receiving Office in connection with an international application (other fees apply only in specific circumstances):

Fees applicable in the national phase

There is no central fee payment mechanism in place. 

Fees that are payable in the national phase to national and regional Offices can be found in the PCT Applicant’s Guide , National Chapters.

Amounts of PCT fees in the international phase

Fee payments in the international phase are generally made to the receiving Offices (ROs) and International Preliminary Examining Authorities (IPEAs). The respective amounts and currencies can be found in the PCT Fee Tables:

Fees that are payable only in particular circumstances, and details of certain reductions and refunds that may be available, are not included in the PCT Fee Table;  they can be found in the PCT Applicant’s Guide , Annexes C, D and E.

Where to pay PCT fees?

Filing-related fees are payable to the receiving Office (RO) with which the international application is filed.  The RO then transmits the search fee to the International Searching Authority (ISA) and the international filing fee to the International Bureau (IB).  Other fees must be paid only under specific circumstances to the respective International Authorities.

Fees payable to the IB as a receiving Office (RO/IB)

In case of direct filing of PCT applications with RO/IB , fees may be paid to RO/IB in Swiss francs, US dollars or Euros, depending on payment method and fee type. The amounts payable, as well as any applicable reductions, are set out in the PCT Applicant’s Guide (Annex C(IB)) .

Fees payable to the IB in particular circumstance only

Special fees payable to the IB (only where applicable)

  • Early publication fee ( PCT Rule 48.4(a) )
  • Fee for publication of information concerning late correction or addition of a priority claim ( PCT Rule 26 bis .2(e) )
  • Fee for publication of a refused request for rectification ( PCT Rule 91.3(d) )

Fees for supplementary international search (only where applicable)

  • Supplementary search fee ( PCT Rule 45 bis .3 )
  • Supplementary search handling fee ( PCT Rule 45 bis .2 ) 
  • Late payment fee ( PCT Rule 45 bis .4(c) )

There are several ways to pay your PCT fees and charges to WIPO :

  • Option 1: Current Account at WIPO
  • Option 2:  credit card (under certain circumstances)
  • Option 3:  eWallet (Apple Pay, Google Pay and Samsung Pay) (under certain circumstances)
  • Option 4:  PayPal
  • Option 5:  bank transfer
  • Option 6: postal transfer (within Europe only)
  • Option 7: bank payment online (secured by SOFORT) (under certain circumstances)

Payment follow-up

Note : WIPO will send a receipt within 10 days of the receipt of the bank or postal transfer.

All payments are acknowledged by PCT Forms and include the contact details of the authorized officer processing the application.  If you do not receive an acknowledgement please contact the authorized officer indicating the PCT application number.

Refund request

What is the World Intellectual Property Office?

The World Intellectual Property Office (WIPO) is a global forum established in 1967 for intellectual property services, policy, information, and cooperation. Its aim is to help governments, businesses, and individuals understand the benefits of protecting intellectual property and how to achieve that protection.

It acts as a global reference source and database for a variety of intellectual property information, including trade mark applications and portfolio management.

What is the international filing system?

The Madrid System is a convenient and cost-effective solution for applying to register and managing trademarks worldwide through a central database facilitated via WIPO. Many but by no means all territories are part of the Madrid system. Notable exceptions include Hong Kong and South Africa. You can use the Madrid System if you have a personal or business connection to one of the System’s members.

In order to file a trademark via WIPO using the Madrid System, the first step is to identify a base trademark – usually in the business’s home territory. The application for an International Registration (IR) is then made via the intellectual property office associated with that base mark. There is an administrative fee paid to that office together with a more significant fee which is paid to WIPO.

The priority system can be used in the same way via WIPO as if you were filing directly.

What is the alternative?

The alternative to filing via WIPO is to file directly with the local trademark office in each territory. The benefit of this approach is that you have a lot more control over the process and the marks are usually filed much more quickly. However, it is necessary to incur the costs of appointing and liaising with local attorneys which adds a significant administrative burden and is usually more expensive.

What are the advantages of filing via WIPO?

When filing in more than two additional territories, the most cost effective method of securing trademark protection is usually to file via WIPO using the Madrid System. The cost of an international trademark includes a basic fee which depends on the type of mark, as well as additional fees per class and per territory.

Any updates to the register (such as a change of name or address) are easily done and subsequent designations can be added at a later date. You can also easily carry out renewals online.

Official notifications will be in the language used in the registration.

What are some of the challenges of using the WIPO system?

Not all territories are part of the Madrid System (e.g. Hong Kong and South Africa), so the only route available to file a trademark application internationally may be by filing directly.

If there is an examination report or a refusal raised by one of the designated territories, there will be additional costs incurred to resolve these issues and local attorneys will still need to be appointed. Whereas, if you were to file directly, the local lawyers in these territories could identify any potential issues prior to filing the application.

The full application to registration process typically takes longer than a direct filing because of the additional administrative delays involved in WIPO communicating between the parties and the registries.

The goods and services are tied to the base mark which means they cannot be edited prior to filing. You do have the option to file in a limited number of classes as opposed to all classes in the base mark, however you cannot edit the goods or services themselves to make them more compliant with local trademark laws prior to filing.

Filing directly provides more certainty and control over the process. For example, it typically takes much longer to find out about issues (e.g. provisional refusals or oppositions) or you may not be notified at all.

If you decide to sell one of your trademarks filed through WIPO using the Madrid System, in some of the countries, you will have to convert it to a local mark first which is an expensive and time consuming procedure.

General service fees

The fees subject to reduction upon establishment of small entity status (37 CFR 1.27) or micro entity status (37 CFR 1.29) are shown in separate columns. Except for provisional applications, each application for a patent requires the appropriate search fee and examination fee in addition to the appropriate fees in the "Patent application filing fees" section below. This means each fee listed as a "Basic filing fee" in the "Patent application filing fees" section should be accompanied by the appropriate search fee listed in the "Patent search fees" section as well as the appropriate examination fee listed in the "Patent examination fees" section. The $400/$200 non-electronic filing fee (fee codes 1090/2090/3090 or 1690/2690/3690) must be paid in addition to the filing, search and examination fees, in each original nonprovisional utility application filed in paper with the USPTO. The only way to avoid payment of the non-electronic filing fee is by filing your nonprovisional utility application via Patent Center. The non-electronic filing fee does not apply to reissue, design, plant, or provisional applications. 

As of the implementation of mandatory electronic filing on February 15, 2020, paper trademark filings are no longer accepted. The paper filing fees are provided for the very limited circumstances in which a paper filing is permitted. The “electronically filed” fees are relevant for most customers.
