Life on Earth depends on a healthy environment. There are visible signs that it is deteriorating. Yet, there has been no noticeable change in our lifestyle to prevent the condition from getting worse than it is now. Putting a strain on the environment through things like working in factories, commuting in fuel-powered cars, and using air conditioners has become an essential part of our everyday lives. The amount of energy we use is essential and cannot be replaced. Following is a reality check of how we contribute significantly to environmental degradation despite knowing how important it is to protect the environment & wildlife

Overpopulation

Humans are overpopulating many parts of our planet. This means there are more demands and less supply . The result is an imbalance in the ecosystem, and the habitats of birds and animals are destroyed, thus threatening human survival. Also, this leads to an increase in fossil fuel consumption and its harmful effects on the environment.

Population growth leads to more waste, so supplies must be provided at a faster rate. As a result, air and water become polluted. The pollution issue is so bad that to date, 2.4 billion people live in areas without clean, drinkable water. As a result of human activity, irreplaceable resources such as water, soil and the air are constantly being polluted. This process takes millions of years to complete. The human race is not only responsible for air, water and soil pollution, but also noise, light and radiation pollution.

Global Warming

The major reason for this is the increased level of CO2, which is caused by the increasing burning of fossil fuels. Over the past 400 years, CO2 levels have surpassed all records. This has led to a rise in earth’s temperature, which has led to the melting of glaciers and a rise in ocean levels.

Non-Veg Diet :

Humans have a long digestive system like that of herbivores, but a majority of the population still consumes non-vegan food. One kilo of wheat is required to raise a chicken, but one kilo can satisfy the hunger of two people. Therefore, a non-vegetarian diet is really costly to the environment.

Deforestation :

In order to build roads and houses, land must be cleared for deforestation. This destroys the habitats of wild animals and birds. The carbon dioxide level rises because no trees are available to absorb the gas, causing global warming.

Excess Usage of Useless Commodities :

We use luxury commodities like leather shoes, belts, jackets and belts made from animals’ skins for vanity’s sake without considering the impact on the animals. Because of this, animals suffer, while we adorn decorative items made from their nails and tusks.

Human activities are in charge of destroying the environment and eradicating humanity, so we know how to do that. We must acknowledge and understand the importance of protecting our environment and take action.

In the last several decades, humanity has systematically degraded the resources and environment of the mother earth in the name of technological development. While we are on the way to increasing our standard of living unknowingly, we are hampering it further. As a society, we have come so far that we no longer need to debate about better living, we can now just live.

Nature has an amazing ability to revive itself when subjected to changes made by natural and manmade factors, but it too has a saturation point, and perhaps we have crossed that already. We have damaged it beyond repair. In addition to deforestation, we have impregnated the water resources with hazardous wastes to the point that they cannot purify the water further on their own. The soil has degraded to a point where it is no longer cultivable. There are too many problems to count, and a perfect solution has yet to be found.

It is already too late and we have gone too far. We won’t have tomorrow to repent if we don’t start working now. It is no longer just about protecting the environment, but about preventing us from getting into more danger. Now is the time to make amends with nature in order to extend the time we can live on Earth for few more centuries.

Therefore, it is amply clear from the facts above that the survival of humanity lies in the fact that we collectively contribute to the cause of protecting our environment. It is a collective issue that needs to be addressed from a developed country to the developing or underdeveloped one. The highly developed countries should not remain in illusion that the environment is purely an underdeveloped world issue! No, together we can survive, if we collectively work to nip this issue in bud.

Protecting the environment creates sustainable development in an economy. An attractive, natural environment encourages both domestic, and international tourism and this create revenue for the country.

Tourism also contributes to the economic growth of a nation as it leads to the creation of jobs for many people (Holden 177). Some people work as tour guides and agents while others work in food and accommodation sector.

Protecting the environment also attracts many foreign investors into the country. Foreign investors invest their money and introduce industries in other nations, thus promoting economic growth (Goodstein 26).

If a country has a terrible environment, investors will avoid making businesses there, and this reduces economic development in a country.

Another way that protecting the environment creates sustainable development is through preservation of natural resources. Most development activities make use of natural resources, and if the environment lacks protection, such resources may become depleted, thus, making further developments impossible.

Also, environmental protection causes sustainable development as governments cut the money spent on health-care costs. A good natural environment protects human beings from diseases like skin cancer, cataracts and other illnesses that arise due to environmental pollution. Besides, there is pollution in lakes and rivers due to the large waste that factories emit. The number of deserts has also increased due to continuous cutting of trees. Toxic gas and liquid air have also caused pollution of water supplies.

Protecting the environment secures both plant and animal lives through preventing ozone depletion. The most common causes of ozone depletion are releasing harmful gases into the atmosphere and cutting down of trees. Depletion of ozone makes higher levels of ultra violet rays to hit into the earth’s surface (McMichael 61).

These rays may cause skin cancer and cataracts among human beings. Equally, ultra violet rays affect growth of plants and aquatic food systems. These rays affect nutrient distribution in plants as well as secondary metabolism, thus causing disease in plants.

Besides, ultra violet rays affect the euphotic zone, which limits productivity of phytoplankton. The euphotic zone is the top cover of water column where there is adequate light to promote net productivity.

Although most phytoplankton can move actively to enhance their efficiency and, thus, their continued existence, contact with ultra violet rays from the sun affects survival rates of phytoplankton. Also, ultra violet rays from the sun affect early developmental phases of shrimp, fish, amphibians and crabs.

Other dangerous effects of ultra violet rays to aquatic life include decreased reproductive ability and weakened development of larvae (McMichael 63).

Considering present levels, solar radiation is a restrictive feature, and small raises in ultra violet exposure could cause noteworthy decrease in the number of animals that feed on these minor organisms.

In conclusion, protecting the environment is essential for enhanced human and plant life, continuity of life, sustainable development of an economy as well as economic enhancement. On this year’s World Environment Day , celebrated on June 5, the UN is drawing links between the health of the planet, and human health, and highlighting the importance of protecting biodiversity, the system that supports life.

“At least 70 per cent of emerging infectious diseases” such as COVID-19 , are crossing from the wild, to people, and “transformative actions are urgently required to protect environment and human rights”. This was the message from David Boyd, the independent UN Special Rapporteur on human rights and the environment, ahead of this year’s Day.

Mr. Boyd added that countries should take urgent action to protect the environment and stop climate disruption, biodiversity loss, toxic pollution and diseases that jump from animals to humans.

UN chief António Guterres said in his message that “nature is sending us a clear message. We are harming the natural world, to our own detriment.”

He noted that habitat degradation and biodiversity loss were accelerating, “climate disruption is getting worse…To care for humanity, we must care for nature.”

Time for natureSince World Environment Day was launched in 1974, it has grown to become the UN’s biggest annual event, advocating for environmental action and raising worldwide awareness of the need to increase protection for the planet’s long-term survival.

The 2020 edition, which has the tagline “Time for Nature”, is being hosted by Colombia, which is organizing several events, streamed live, which can be accessed here, or on social media. The theme is biodiversity protection, at a time when one million animal and plant species are believed to be on the brink of extinction.

A failure to do so, warns UNEP, and an attempted return to business as usual, risks seeing inequalities rising even further, and a worsening of the degradation of the planet, at a time when one million animal and plant species are on the brink of extinction.

NEED AND IMPORTANCE OF ENVIRONMENTAL LAWS IN INDIA

Introduction.

We all need a healthy and clean environment to live in. It is not only a basic need but a necessity. Climate change, which wreaks havoc on human life, can easily be triggered if we won’t take good care of our environment. And it is now visible and clear that if the implementation of laws on the protection of the environment does not take the right turn, it will be nearly impossible to leave healthy earth for the next generation. Preservation and restoration of the environment can not be achieved alone by a single person or organization. We need a global effort to decrease the level of pollution and restore this environment by making more careful use of resources. Because of this, most of the countries in this world have realized it and in return have formulated laws for the same and India is doing something the same as them. [1]

CONSTITUTION AND ENVIRONMENT

In the 42 nd Amendment Act, 1976, a new provision was added in Part IV-A which deals with “Fundamental Duties”. This article specifies fundamental duties with respect to the environment. It says that it is the duty of every citizen of India to protect and improve the natural environment including forests, lakes, rivers, and wildlife, and to have compassion for living creatures. Article 21 states the Right to life, which also includes the right to a proper clean environment which is free from infections and diseases. The right to life will become senseless if there is no healthy environment. [2]

CLIMATE CHANGE LAWS AND POLICY FRAMEWORK IN INDIA

India for climate change does not have any special or specific legislation. Although India has taken some worthwhile measures to combat climate change. India needs to decrease the effects of climate change as much as it can, since the population is large and, with that, India is aware of it’s global responsibilities towards climate change. India ranks 6 th in terms of energy and demand when compared to the whole world. And, in upcoming years, this rank will increase not only the demand for oil but also sea and air transportation, which in the end leads to energy consumption and degradation of the environment. With all of this, India needs a strong framework and laws on the protection of the environment. India has been very active in proposing projects like a Clean Development Mechanism (CDM). The Indian government has been trying to pass out initiatives and plans which decrease the emission of greenhouse gases, which are the very need of the hour.

NEED FOR ENVIRONMENTAL LAWS

  • The present situation of the environmental laws and protection in India:

According to the India State Forest Report 2019, India has 21.67% of its land under forest cover, which is way less than the minimum 33% forest area required in a country to maintain ecological balance. [3] This report also stated that even though the forest cover has increased, there is still a heavy decrease in forest cover in the north- east India, which is the main area of biodiversity in India. The Central Pollution Control Board plays only a mere role and, with that, the Indian environmental laws have been said to have many loopholes and a very weak framework. Even though there are several laws for environmental protection in India, it still ranks 5 th on the list of most polluted countries. [4]

  • Relation between deadly diseases and environmental degradation:

The exploitation of wildlife, deforestation, the environment and degradation of ecological habits always result in outbreaks of deadly diseases. The question is why and how did this outbreak occur? Well, the answer to this lies in anthropogenic pressure.  This occurs when humans are in continuous and regular contact with wildlife and hence allowing the virus to evolve, mutate and transit into humans, which results in the birth and outbreak of a new and deadlier virus and diseases. These effects are in front of all of us humans and it is high time that preventive measures are taken. That’s why we need stricter laws and the old laws should be amended to meet the needs of the present situation. Buffer zones for reforestation should be made so that the interaction of humans with wildlife ends. Eco-tourism does help the economy increase, but it also backfires and for prevention, stringent laws for the protection of the environment are needed. [5]

  • Environment Court

Cases related to environmental pollution, ecological destruction and conflicts over natural resources are increasing, no doubt. And, with this, there is a need for more natural scientists who have expertise in this field. These cases require immense attention and a high level of expertise. Stringent laws are needed for these cases along with a good amount of scientific and technical sophistication. The experience shows that the standard of Criminal Courts under the arrangements of the Water Act, Air Act and the Environment (Protection) Act never arrive at their decision either due to the responsibility in these Courts or since there could be no appropriate enthusiasm for the meaning of the climate matters with respect to those responsible for leading those cases. After this, any order passed by authorities under these acts gets immediately questioned by the industries in courts and then those proceedings take years to reach a conclusion.

It is, thus, important to set up different hardware to chop down the defences which are impeding the execution of natural regulations. Further, the legal officials alone will most likely be unable to see the value in logical and specialized perspectives. It is, in this way, presented that arrangements be made for the foundation of the Climate Courts with one adjudicator and two specialists from the environmental and other sciences. [6]

DO WE NEED A NEW CLIMATE LAW?

We don’t require an environment-centred regulation in India, nor do we truly need any significant revisions to existing regulations to focus on environmental alleviation. Instead, environmental change ought to be one of the many aspects that ought to be considered in the execution of any regulation/strategy/program (alongside air pollution, energy access, work, energy security, orientation imbalances, biodiversity and so forth.). Existing regulations don’t give insurance against environmental change; a peculiarity needs a planned activity that of some sort or another is hard to accomplish absolutely through change. The resident’s advantage isn’t focused on the environmental activity at present; this should be changed through regulation.
