7 Types of Homework for Students

There are seven types of homework. These are practice, preparation, extension, integration, research, application, and flipped homework.

Each type of homework has its own role for students learning. The important task for teachers is to select homework that will best provide holistic support to a student.

This doesn’t mean just supporting students for the upcoming exams but also ensuring students are not overwhelmed by homework and that they can still live a balanced life outside of school.

Types of Homework

1. practice.

Practice is the most common task students have when they are given homework. It entails attempting to reinforce information learned in school so that students will commit it to long-term memory.

An example of practice homework is math workbooks. Usually, a teacher will complete the math task in class so students know how to do it, then give them a workbook of 20 – 50 tasks to complete overnight to reinforce the task.

The benefit of practice homework is that it can certainly help students commit what they learned in class to memory. This is especially the case if teachers used spaced repetition. This is a strategy whereby the teacher re-introduces things learned in previous weeks and months during homework revision so the information is not lost over time.

The downside of practice homework is that the child is learning on their own during this period. This means that, if the child hasn’t sufficiently learned the content in class, they don’t have anyone to help them during homework time. This can lead to a great deal of frustration and despair for students staring at a piece of paper feeling lost and confused.

2. Preparation

Preparation homework is given to students before a lesson so they have the important information at hand before class.

Commonly, this occurs when teachers provide reading materials for students to look over between class. They then come to class having read the materials so they are ready to discuss and debate the topics.

It’s also commonly used in language learning, where it’s called pre-teaching of vocabulary. The teacher provides vocabulary to learn before class so the students can come to class and practice it together.

The benefit of preparation homework is that it bunches a lot of the didactic (non-interactive) parts of learning into the pre-class time so students can spend most of their time in class interacting with the teacher and peers.

The downside of preparation homework is that it rarely works as expected. Teachers often spend the first 10 to 15 minutes of class re-teaching what was supposed to be done for homework either because students found it too hard or they didn’t do the tasks.

3. Extension

Extension homework involves providing students with tasks that are based upon what was learned in class, but goes over and above those tasks.

It is the equivalent of teaching a student to swim then letting them out into the ocean. The students have to apply their knowledge in a new context without the support or ‘ scaffolding ’ of a teacher hovering over their shoulders.

The benefit of extension homework is it can give students a lot of confidence. They can go home and feel as if they’re excelling at their work when they find that they’re doing it without the support of a teacher.

The downside of extension homework is that it can be risky: by definition, students are extending themselves beyond what was learned in class, meaning they will come across new information and new contexts where they might need help that’s not available at the time.

4. Integration

Integration homework requires students to bring together, or ‘integrate’, knowledge from various subjects and knowledge areas into one project.

The homework may involve the integration of history lessons with writing lessons to create a book report, or the integration of math with business studies to create a business plan.

Integration is great for students to draw connections between things they have learned in various different classes at school. However, it also involves a lot of complexity that may make students feel confused or overwhelmed.

5. Research

Research homework involves using your time after school and on weekends to gather data that will be discussed in class.

Often, this can involve interviewing family members, taking photos around your community, or looking up information on the internet.

The benefit of research homework is that students often come to class with exciting things to share. They will also come with questions to help stimulate conversation in class.

However, it’s important for teachers to be aware that not all students have access to high-speed internet and other resources to conduct research. In fact, in my homework statistics article, I discussed how a staggering 24% of low-income American teens regularly fail to complete homework due to lack of access to technology.

6. Application

Application homework involves taking knowledge learned in class and applying it to real-world settings.

This is common in immersive language learning settings, for example, when teachers ask students to go out into the streets and practice new vocabulary when ordering a drink or buying food.

The benefit of application homework is that it gives real-world context to what was learned in class. By applying your knowledge, you can more effectively commit it to memory than simply rote learning it at your kitchen table.

Application in a real-world setting provides a context and a story that you can easily pull from your memory in the future, helping you to retain information long-term.

7. Flipped Homework

The flipped learning movement is a movement that involves making students learn at home on their own then come to class to practice it.

For teachers, this means thinking about school as the space for ‘traditional’ homework and home as the space for instruction.

This is increasingly popular with technology and hybrid learning environments. For example, a teacher might assign a YouTube video to watch as homework before class. Then, the class involves dissecting the video and critiquing it.

The benefit of flipped learning is that it maximizes time for constructivist and hands-on active learning in the classroom. The downside is students can get confused during preparation, they may not complete the preparation work, or technology may fail on them.

What are the Functions of Homework?

Homework serves multiple purposes. These include:

  • Getting Ahead: Many schools and parents give their children homework (including private tutoring help so their children can have an advantage in life over other children.
  • Keeping Up: On a societal level, many governments encourage homework so that students can keep up with other societies in the ‘education race’ of the 21st Century. Some societies, like South Korea, heavily emphasize homework, and others feel they need to keep up.
  • Catching Up: Many students are assigned homework to catch up with the rest of their class. If you find a topic very difficult, you may find you need to spend a lot more time on your own working through the information than your peers.
  • Retention: Homework helps you to repeat and retain information. With extra practice, you can commit information to memory.
  • Excitement: Some well-made homework can get students excited to come to class to discuss what they did.
  • Application: Situation-based learning, where you’re applying what you learned in class to real-world situations, can help progress students’ knowledge in ways that you can’t in school.
  • Home-School Relationships: Homework also serves the purpose of ensuring parents know what’s going on in school. Many parents like to see what children are learning so they can monitor their children’s progress and keep teachers accountable.

Homework comes in all shapes and sizes. While many teachers stick to the old fashioned repetition homework mode, I’d encourage you to try out a range of other types of homework that can keep students engaged, encourage more discussion and collaboration in class, and ensure that the difficult work where students need the teacher’s help takes place in the classroom. This will provide maximum support for your students, help propel them forward, and prevent arguments for why homework should be banned .

General Principles of Assignments in Real Estate Transactions

Assume a seller, ABC Company, enters into a contract to sell a parcel of land (referred to here as “Blackacre”) to Ms. Green. Ms. Green subsequently assigns her interest in the contract to Mr. Smith. Such assignments of contracts of purchase and sale raise a number of practical issues—e.g. notice to the seller, payment for the assignment, and transfer of the deposit—that affect not only the seller but also the original purchaser and the eventual purchaser. A party wishing to assign its interest in a contract of purchase and sale to a new party should not assume that the matter is as simple as entering into an assignment with the new party and then walking away and forgetting about the contract.

A real estate contract will often contain provisions that limit or prohibit an assignment of a party’s interest in the contract. If the contract is silent as to the rights to the parties to assign their interests in the contract, then the rights of the parties, with few exceptions, can be assigned. Normally, assignments of contracts relating to the purchase and sale of real estate involve the purchaser assigning its interest in the contract; however, it is not unheard of to have the seller assign its interest in the contract.

In our scenario, to be binding on it as the seller, ABC Company must be given notice of the assignment, although it does not have to receive a copy of the assignment or the business terms relating to the assignment. If ABC Company has been given notice that Ms. Green’s interest in the contract has been assigned, it may be concerned that she is ‘flipping’ her interest in the contract for a profit. Consequently, ABC Company may wish to seek advice as to whether the contract is enforceable.

Assuming that Mr. Smith is paying Ms. Green a specified amount of money for the assignment, the question arises as to when this money will be paid. Ms. Green will want the money to be paid when they enter into the assignment but Mr. Smith will want to pay at the time that they complete the purchase and sale of Blackacre. In most cases, the latter time period is the norm but, in any case, money paid for an assignment is subject to the Goods and Services Tax.

Ms. Green will likely have paid a deposit to ABC Company pursuant to the contract and will want the deposit to be repaid to her at the time of the assignment rather than having to wait until the purchase and sale of Blackacre is completed. It would not be unusual for Mr. Smith to reimburse the deposit to Ms. Green at the time that they enter into the assignment.

Mr. Smith should look to obtain assurances by way of representations and warranties from Ms. Green that the contract to purchase Blackacre is in full force and effect and that her interest can be assigned to him. In turn, Ms. Green should look to obtain representations and warranties from Mr. Smith that he will fulfill her obligations to complete the purchase of Blackacre since an assignment will not release Ms. Green of her obligations under the contract unless such release is specifically provided for—and has been agreed to by ABC Company.

Frequently, and contrary to the scenario presented here, a contract for a real estate transaction will often limit the right of the purchaser to assign its interest in the contract. A common limitation is that “. . . the purchaser may only assign its interest in the contract with the consent of the seller, such consent not to be unreasonably withheld.” In most cases, it would not be unreasonable for the seller to insist that the assignee contract directly with the seller to fulfill the obligations of the assignor under the contract so that, if there is a default, the seller has the right to seek remedies against both the assignor and the assignee.

So long as all parties to a contract of purchase and sale are aware of their rights and obligations, the completion of a purchase and sale where a contract has been assigned can and should proceed in a straightforward manner.

8 Ways to Serve Missionaries on Home Assignment

Missionary home assignment is a time when missionaries return to their sending country to rest, refocus and connect with their support base. While a big goal of missionary home assignment is time to recharge before heading back to the mission field, many missionaries will tell you home assignment is not always relaxing .

Traveling around their home country to see family, friends, supporters and sending churches can be wonderful, but it can also be tiring. Here are a few ways to serve missionaries on home assignment.

1. Arrange for Their Transportation

Since many missionaries won’t have a car in North America, it can be a huge stress to figure out how to get from place to place while on home assignment. From picking them up from the airport to lending your car for a period of time, the gift of transportation can greatly reduce the stress of preparing for home assignment.

2. Coordinate Their Housing

Missionaries spend the majority of home assignment traveling to connect with all of their family, friends and supporters across the country. If you have extra space or you know of connections in cities they will be visiting, send an email to let your missionary know. It could be a huge answer to prayer as they prepare to return.

3. Help Them Schedule Fun

Whether it’s a day away with a friend, a week-long getaway or a family outing, the gift of fun can help missionaries rest and recharge before heading back to the field. This could mean anything from ball game or amusement park tickets to the use of a timeshare or summer house. Your gift, no matter how big or small, could be a huge blessing of memories made.

4. Set Up Time to Share

Stories from the field can range from heartbreaking to inspiring, but they all point to the work God is doing through an ordinary person who said “yes” to his call. Many congregants first hear the call to support overseas work or to go themselves while hearing from other missionaries. Giving missionaries time to share helps the whole congregation connect with the work your church is supporting.

5. Give Them A Night Out

Being far away from home can be an added stressor to a marriage, so if you know a missionary family on home assignment, offer to babysit the kids, and encourage the parents to enjoy a date together.

6. Invite Them to Join Your Group

Even if missionaries will only be in town a short time, invite them to be a part of your small group or Bible study. They may not be able to make it every week, but the invitation lets them know they are a welcome and important part of your church family.

7. Keep Praying for Their Overseas Ministry

Just because the missionary is not on the field doesn’t mean the work stops! Many times, other missionaries or local leaders must step up to do the work of the missionary on home assignment. Keep praying for the ministry to grow and for the local leaders to thrive in their work.

8. Ask Intentional Questions

Many workers have said they feel like people back home don’t always want to hear about their life on the field. Let them know you care by asking questions about their day-to-day experiences. Some of my favorites are:

  • What does your day look like on the field?
  • What’s something you’ve been excited about lately?
  • What’s grocery shopping like in your country?

By showing an interest in the details of their ministry, you are letting missionaries know you care about their life and work.

Understanding how assignments of mortgage work.

The bank or other mortgage lender that provides a borrower with the funds to purchase a home often later transfers or assigns its interest in the mortgage to another firm. When this happens, the borrower will start sending monthly mortgage payments to the new owner of the mortgage instead of the original lender. Some other things, such as the available modes of payment, many also change.  However, the general terms of the mortgage, such as the interest rate and payment amounts, will stay the same.

Mortgage Assignment Basics

Mortgages are assigned using a document called an assignment of mortgage. This legally transfers the original lender’s interest in the loan to the new company. After doing this, the original lender will no longer receive the payments of principal and interest. However, by assigning the loan the mortgage company will free up capital. This allows the original lender to make more loans and generate additional origination and other fees.

At closing, borrowers sign a document granting the original lender the right to assign the mortgage elsewhere. This means the original lender doesn’t have to ask for permission to assign the mortgage but can do so whenever it wants to. Often this occurs within a few months after the closing, but it can happen at any time during the term of a mortgage. Once a loan has been assigned, it can be assigned again.

The assignment of mortgage document uses several pieces of information to accurately identify the specific mortgage that is being transferred. These generally include:

The name of the borrower

The date of the mortgage

The jurisdiction where it was recorded

The amount of money that was originally loaned

A legal description of the home or other property used as collateral to secure the loan.

Although a lender doesn’t need to request the borrower’s permission before assigning a mortgage, the lender does have to notify the borrower after the mortgage has been assigned. This notice will generally provide the new lender’s name, contact information and mailing address or other information need to make payments.

Effects of Mortgage Assignment

When a mortgage is assigned, the original terms of the mortgage remain unchanged. The monthly principal and interest, interest rate and total number of payments required to pay the loan off will be the same as on the mortgage when it was signed at closing.

A company assigned a mortgage may have different methods of accepting monthly payments, such as online payments, paper checks or money orders. A borrower who wants more payment methods may be able to get a new mortgage holder to provide them upon request.

Some things may change, however. For instance, the new owner of the mortgage may have a different method of handling escrow payments that are used to pay property taxes and the premiums for hazard insurance. The law requires mortgage companies to charge no more than one-twelfth the annual cost of property taxes and insurance each month. However, they can also require borrowers to maintain a cushion of up to one-sixth the annual total required to pay taxes and insurance. If a new mortgage company has a different policy on this cushion, it could change the total monthly payment.

The borrower also does not need to notify the local taxing authorities or the hazard insurance provider about the assignment. The new holder of the mortgage is required to handle these notifications.

Borrowers should check the information about where payments are supposed to go. This need to be accurate so payments will be directed correctly to the holder of the mortgage and the borrower will receive credit for them.

Another important matter that may change when a loan is assigned is the procedure the mortgage company will follow in the event of default. Borrowers should make themselves familiar with the notification methods used by the new mortgage to let them know if payments are not being received and foreclosure is in the offing.

The Bottom Line

Home mortgages are often assigned by their original lenders to other companies. Assignment usually doesn’t change much for the borrower, except that the payments will go to a different address. The original loan amount, interest payment, term and monthly principal and interest part of the payment will stay the same. Assigning mortgages frees up money for the lenders to make more loans. Borrowers don’t have to be told a mortgage will be assigned, since they agree to this at closing. However, they must be notified after an assignment and told how to contact the new mortgage holder.

Visualize a real estate purchase contract with just a few extra words added to your name as the buyer. It would look something like this:

"Buyer: John J. Doe, and/or assigns."

That's it. You've provided for a real estate assignment contract. It seems simple, and it is, and it opens up many opportunities for profits in real estate investing .

Who or What Is an 'Assign'?

Your "assigns" would be anyone to whom you want to pass your purchase rights. Maybe you've effectively locked up a property with a purchase contract. You can now go ahead and buy it, flip it, rehab and rent it, or apply any other strategy that's legal.

Or you can also pass it along to someone else for profit, never actually buying it yourself. This is an assignment contract.

Control is all in your court at the beginning; you don't have to turn the deal over to anyone else if you decide not to, or until such time as it best suits you financially if you decide to go ahead with the assignment. The downside is that if you can't find anyone to take over the contract and that was your intention, you'll be legally obligated to consummate the sale yourself.

You're not just passing your purchase rights along. You're also passing your obligations in the contract. This means that you're no longer involved in the transaction at all after the assignment takes place.

You don't have any right to make claims against the seller if there are problems with the deal moving forward, however. The person or company to whom you've assigned the deal to is now responsible for taking the deal through to closing. 

Of course, this assumes that you've actually assigned the contract to another party. Until that time, you're on the hook. The contract is a legal document, governed by individual state laws, so the seller might have various means of recourse if you don't assign the contract and you don't follow through and close on the property.

You probably won't be receiving your fee or profit until closing, so you might be understandably nervous as you wait for the deal to close.

A Note About State Laws

A few states won't let you transfer liability in this way, so you might want to check with an attorney in your area to make sure you understand the laws in your jurisdiction before you jump in with both feet.

HUD homes and real estate owned properties or foreclosures generally aren't open to assignment in any state.

The simplest way to profit in this situation is to locate one or more buyers in your buyer database, show them the value in the deal, and take a referral or "bird-dog" fee for bringing it to them.

Bird-dogging doesn't involve getting technically involved in the deal at all. It's more or less an arrangement where you locate the property, then say, "Here you go, Investor," and the investor takes it from there, personally entering into a purchase contract with the seller—in exchange for a fee to you, of course.

You'll then assign your rights to the deal, and they'll go forward to closing.

They'll pay you your fee at or after closing. You could profit handsomely, even though all you had at risk was whatever earnest money deposit was required. And that risk is pretty low if you know who your buyers are likely to be before you contract the property, assuming the value is there.

You'll also begin to build and maintain an active investor buyer list for your customer pool. This is critical because you really want to be sure you have a ready buyer or two for a home before you commit that earnest money. You should be covered pretty well if you do a good job of building your list .

The list should include both fix-and-flip and rental property investors who have an interest in buying depending on the condition of the property. 

Rental investors normally want a house ready for occupancy, or at least with only cosmetic or minor repairs necessary.

Back-to-Back Closings for a Flip Sale

You can also take on the purchase personally and immediately selling it to another investor or a retail buyer. You might want to take this approach because your profits would be more significant.

Unfortunately, you can no longer use the funds from one deal to close on another in simultaneous closings since the mortgage crisis in 2007. Lenders just won't allow it. But you can explore resources for short-term funding, such as a relative, your own cash, or a hard money lender.

You only need the money long enough to close the purchase and resell. This might be hours, but it should never be more than a day or two.

A Great Real Estate Investment Strategy

Ideally, you've perfected your techniques and you can locate really great deep discount real estate deals with others. There are many ways to get to a good deal early, and your value to your buyer-customer is that you've got the property in your control. They'll only get it if you pass it along.

You can make this work well for you by honing two tasks: First, have a really good buyer database with information about what each is looking for, and second, learn and put into play various strategies for locating great property deals before they become general knowledge.

Using real estate assignment contracts can be your ticket to real estate investing profits with little of your own money at risk if you get these two things in line and operating for you.

Among the Russian listings, Afisha (www. afisha.ru ) magazine is the most popular one.  While being slightly pretentious, it provides a lot of information and has good nightlife and art listings.

Another interesting newspaper is Bolshoy Gorod – www.bg.ru – which is distributed for free and has extensive listings. They also have a blog for each area of Moscow (in Russian).

Finally, Look At Me - www.lookatme.ru – is a sure source to find some party or exhibition you like.

The weekly Komsomolka is the local version of the UK Sun, but intelligentsia (smart people) prefer the free Bolshoy Gorod, which is a bit like the local version of The Village Voice, but not as big.

The "mainstream" fashion is determined by bi-weekly Afisha ( www.afisha.ru ) magazine.

The weekly Expert ( www.expert.ru ) and Itogi ( www.itogi.ru ) magazines provide comprehensive business, finance, and politics analysis.

The monthly magazines are anything from Playboy to Forbes, and from Cosmopolitan to The Rolling Stone.

Foreign Press

You can buy foreign magazines and newspapers in Moscow. Usually, they are sold in 5-star hotels, but the prices there are much too high. Also, you can try some newstands in the city (especially on Tverskaya St.), but the prices are high also, and the selection is poor.

However, there's a couple of places in Moscow, where you can get almost any magazine or newspaper, in English and in other languages. 1. Maxim's News Stand. They have everything, if they don't -- you can order. Prices are lower than on the cover. Also, they sell books and movies in English. Metro: Savyolovskaya (grey line, north center), Address: Nizhnyaya Maslovska, #2 (an underground pass near Savyolovskaya metro). Open hours: Mon-Sat 11.00 to 19.30 2. Arbat Supermarket. Just next to the entrance they sell some English-language magazines and fresh newspapers. Metro: Arbatskaya. Address: Novy Arbat st, Novoarbatsky supermarket - grocery store (there's only one, the entrance is on the street side). 3. Bookberry. The new Moscow book supermarket has an extensive section of foreign magazines and newspapers at moderate prices. Metro: Arbatskaya, Tverskaya (blue, purple line). Address: Boulevard Ring (walk from Novy Arbat towards Pushkinskaya square along Zubovsky boulevard and the shop will be to your left). Open hours: Mon-Sun 10.00-20.00

4. Gorbushka. The famous Moscow pirate CD, DVD, Software and official electronics market specializes in foreign music and DJ magazines. Address: metro Bagrationovskaya (Moscow west), a large building outside the exit - the crowds walks in its direction. Open hours: Mon-Sun 10.00-20.00 If for some reason you can't buy the thing you need in any of the shops above, try to go to some European or American medical or dental center - they have a great selection of magazines in their reception areas.

What is Assignment?

If you own a piece of property or have rights in a contract and would like to transfer either of these items to another person, you can make an assignment. For instance, if you own a trademark, you could transfer rights to your mark to someone else interested in using the mark.

Before an assignment will be legal, several requirements must be met:

  • All parties must be legally capable.
  • The objects being transferred must be legal.
  • Consideration should be included.
  • All parties must consent to the assignment.

One of the most common forms of assignment is a wage assignment . For instance, if you owe child support, alimony, back taxes, or some other form of debt, the court can require your employer to withhold a portion of your paycheck.

It is also possible to make an assignment for a mortgage. With a mortgage deed, you can give property interest to a lender in exchange for regular payments. Lenders frequently sell mortgages to other lenders. To complete the sale, a mortgage assignment document would need to be used. This document can clarify how payments will be made and can also be used to alter the terms of the mortgage.

Several factors can influence how assignment plays out. In particular, the language of the contract involved in the assignment can impact this process. Certain contracts, for instance, contain clauses that completely eliminate the possibility of assignment. In other contracts, assignment can only occur if the party being assigned the rights and responsibilities of the contract consents.

In some cases, the person making the assignment will still be liable for the performance of the contract . To make sure the contract is completed, a contract can include a provision that requires the original party to make sure the obligations of the contract are fulfilled, even if they have assigned their rights to a third party.

If the assignment significantly changes the terms of the contract, the agreement will usually not be enforceable. For instance, if assignment reduces the contract's value or exposes the other party to more risk, this would be a significant alteration, meaning the courts would not enforce the contract.

It's also possible that an assignment of contract would be restricted by the law. For instance, some states do not allow an employee's future wages to be assigned. Similarly, claims against the federal government usually cannot be assigned. Because it can increase the possibility of litigation, you are not allowed to assign a personal injury claim.

Delegation or Assignment?

In many cases, a person may want to find someone else to fulfill their contractual duties without having to assign the contract. In these cases, you would use a delegation instead of an assignment. Understand, however, that not all contractual obligations are eligible for delegation.

Personal services, for example, usually cannot be delegated. This is because these services are very specific. For instance, if you hired a musical act to play a party, the musician could not delegate their performance to another artist because they were hired with their specific style in mind. If one party wishes to eliminate the possibility of delegation, they should make sure the contract includes language restricting the practice.

Novation and Assignment

In regard to assignment, it's important to understand that only contractual benefits can be assigned. It is not possible to assign the burden of a contract . For example, if a contractor is hired for a construction project, they could assign their payment but not their obligation to complete the project.

Once an assignment has taken place, the assignee will be able to receive the contract's benefits. The assignee also has the ability to file a lawsuit to enforce their new contractual rights. If there are parts of the contract that still need to be completed, the assignor would be responsible for making sure that this occurs. If the contract is not fulfilled, the assignor would be legally liable since they cannot assign the burden.

Typically, when an assignment takes place, performance of the contract will be taken over from the assignee, and the assignor will request an indemnification for breach of contract.

Assignment of Benefits: What It Is, and How It Can Affect your Property Insurance Claim

What is an Assignment of Benefits?

In the context of insured property claims, an assignment of benefits (AOB) is an agreement between you and a contractor in which you give the contractor your right to insurance payments for a specific scope of work .  In exchange, the contractor agrees that it will not seek payment from you for that scope of work, except for the amount of any applicable deductible.  In other words, you give part of your insurance claim to your contractor, and your contractor agrees not to collect from you for part of its work.

The most important thing to know about an assignment of benefits is that it puts your contractor in control your claim , at least for their scope of work.  Losing that control can significantly affect the direction and outcome of your claim, so you should fully understand the implications of an AOB (sometimes called an assignment of claims or AOC) before signing one.

How Does an Assignment of Benefits Work in Practice? 

Let’s say you’re an insured homeowner, and Hurricane Ian significantly damaged your roof.  Let’s also assume your homeowner’s policy covers that damage.  A roofer, after inspecting your roof and reviewing your insurance policy, might conclude that your insurer is probably going to pay for a roof replacement under your insurance policy.  The only problem is that it’s early in the recovery process, and your insurer hasn’t yet stated whether it will pay for the roof replacement proposed by your contractor. So if you want your roof replaced now, you would ordinarily agree to pay your roofer for the replacement, and wait in hopes that your insurer reimburses you for the work.  This means that if your insurance company refuses to pay or drags out payment, you’re on the hook to your roofer for the cost of the replacement.

As an alternative to agreeing to pay your roofer for the full cost of the work, you could sign an assignment of benefits for the roof replacement.  In this scenario, your roofer owns the part of your insurance claim that pertains to the roof replacement.  You might have to pay your roofer for the amount of your deductible, but you probably don’t have to pay them for the rest of the cost of the work.  And if your insurance company refuses to pay or drags out payment for the roof replacement, it’s your roofer, and not you, who would be on the hook for that shortfall.

So should you sign an AOB?  Not necessarily.  Read below to understand the pros and cons of an assignment of benefits.

Are There any Downsides to Signing an Assignment of Benefits?

Yes.  

You lose control of your claim . This is the most important factor to understand when considering whether to sign an AOB.  An AOB is a formal assignment of your legal rights to payment under your insurance contract.  Unless you’re able to cancel the AOB, your contractor will have full control over your claim as it relates to their work. 

To explain why that control could matter, let’s go back to the roof replacement example.  When you signed the AOB, the scope of work you agreed on was to replace the roof.  But you’re not a roofing expert, so you don’t know whether the costs charged or the materials used by the roofer in its statement of work are industry appropriate or not.  In most cases, they probably are appropriate, and there’s no problem.  But if they’re not – if, for instance, the roofer’s prices are unreasonably high – then the insurer may not approve coverage for the replacement.  At that point, the roofer could lower its prices so the insurer approves the work, but it doesn’t have to, because it controls the claim .  Instead it could hold up work and threaten to sue your insurer unless it approves the work at the originally proposed price.  Now the entire project is insnared in litigation, leaving you in a tough spot with your insurer for your other claims and, most importantly, with an old leaky roof.

Misunderstanding the Scope of Work.   Another issue that can arise is that you don’t understand the scope of the assignment of benefits.  Contractor estimates and scopes of work are often highly technical documents that can be long on detail but short on clarity.  Contractors are experts at reading and writing them.  You are not.  That difference matters because the extent of your assignment of benefits is based on that technical, difficult-to-understand scope of work.  This can lead to situations where your understanding of what you’re authorizing the contractor to do is very different from what you’ve actually authorized in the AOB agreement.

In many cases, it’s not necessary .   Many contractors will work with you and your insurer to provide a detailed estimate of their work, and will not begin that work until your insurer has approved coverage for it.  This arrangement significantly reduces the risk of you being on the hook for uninsured repairs, without creating any of the potential problems that can occur when you give away your rights to your claim.

Do I have to sign an Assignment of Benefits?

No.  You are absolutely not required to sign an AOB if you do not want to. 

Are There any Benefits to Signing an Assignment of Benefits?

Potentially, but only if you’ve fully vetted your contractor and your claim involves complicated and technical construction issues that you don’t want to deal with. 

First, you must do your homework to fully vet your contractor!  Do not just take their word for it or be duped by slick ads.  Read reviews, understand their certificate of insurance, know where they’re located, and, if possible, ask for and talk to references.  If you’ve determined that the contractor is highly competent at the work they do, is fully insured, and has a good reputation with customers, then that reduces the risk that they’ll abuse their rights to your claim.

Second, if your claim involves complicated reconstruction issues, a reputable contractor may be well equipped to handle the claim and move it forward.  If you don’t want to deal with the hassle of handling a complicated claim like this, and you know you have a good contractor, one way to get rid of that hassle is an AOB.

Can my insurance policy restrict the use of AOBs?

Yes, it’s possible that your Florida insurance policy restricts the use of AOBs, but only if all of the following criteria are met:

  • When you selected your coverage, your insurer offered you a different policy with the same coverage, only it did not restrict the right to sign an AOB.
  • Your insurer made the restricted policy available at a lower cost than the unrestricted policy.
  • If the policy completely prohibits AOBs, then it was made available at a lower cost than any policy partially prohibiting AOBs.
  • The policy includes on its face the following notice in 18-point uppercase and boldfaced type:

THIS POLICY DOES NOT ALLOW THE UNRESTRICTED ASSIGNMENT OF POST-LOSS INSURANCE BENEFITS. BY SELECTING THIS POLICY, YOU WAIVE YOUR RIGHT TO FREELY ASSIGN OR TRANSFER THE POST-LOSS PROPERTY INSURANCE BENEFITS AVAILABLE UNDER THIS POLICY TO A THIRD PARTY OR TO OTHERWISE FREELY ENTER INTO AN ASSIGNMENT AGREEMENT AS THE TERM IS DEFINED IN SECTION 627.7153 OF THE FLORIDA STATUTES.

627.7153. 

Pro Tip : If you have an electronic copy of your complete insurance policy (not just the declaration page), then search for “policy does not allow the unrestricted assignment” or another phrase from the required language above to see if your policy restricts an AOB.  If your policy doesn’t contain this required language, it probably doesn’t restrict AOBs.

Do I have any rights or protections concerning Assignments of Benefits?

Yes, you do.  Florida recently enacted laws that protect consumers when dealing with an AOB.

Protections in the AOB Contract

To be enforceable, a Assignments of Benefits must meet all of the following requirements:

  • Be in writing and executed by and between you and the contractor.
  • Contain a provision that allows you to cancel the assignment agreement without a penalty or fee by submitting a written notice of cancellation signed by the you to the assignee:
  • at least 30 days after the date work on the property is scheduled to commence if the assignee has not substantially performed, or
  • at least 30 days after the execution of the agreement if the agreement does not contain a commencement date and the assignee has not begun substantial work on the property.
  • Contain a provision requiring the assignee to provide a copy of the executed assignment agreement to the insurer within 3 business days after the date on which the assignment agreement is executed or the date on which work begins, whichever is earlier.
  • Contain a written, itemized, per-unit cost estimate of the services to be performed by the assignee .
  • Relate only to work to be performed by the assignee for services to protect, repair, restore, or replace a dwelling or structure or to mitigate against further damage to such property.
  • Contain the following notice in 18-point uppercase and boldfaced type:

YOU ARE AGREEING TO GIVE UP CERTAIN RIGHTS YOU HAVE UNDER YOUR INSURANCE POLICY TO A THIRD PARTY, WHICH MAY RESULT IN LITIGATION AGAINST YOUR INSURER. PLEASE READ AND UNDERSTAND THIS DOCUMENT BEFORE SIGNING IT. YOU HAVE THE RIGHT TO CANCEL THIS AGREEMENT WITHOUT PENALTY WITHIN 14 DAYS AFTER THE DATE THIS AGREEMENT IS EXECUTED, AT LEAST 30 DAYS AFTER THE DATE WORK ON THE PROPERTY IS SCHEDULED TO COMMENCE IF THE ASSIGNEE HAS NOT SUBSTANTIALLY PERFORMED, OR AT LEAST 30 DAYS AFTER THE EXECUTION OF THE AGREEMENT IF THE AGREEMENT DOES NOT CONTAIN A COMMENCEMENT DATE AND THE ASSIGNEE HAS NOT BEGUN SUBSTANTIAL WORK ON THE PROPERTY. HOWEVER, YOU ARE OBLIGATED FOR PAYMENT OF ANY CONTRACTED WORK PERFORMED BEFORE THE AGREEMENT IS RESCINDED. THIS AGREEMENT DOES NOT CHANGE YOUR OBLIGATION TO PERFORM THE DUTIES REQUIRED UNDER YOUR PROPERTY INSURANCE POLICY.

  • Contain a provision requiring the assignee to indemnify and hold harmless the assignor from all liabilities, damages, losses, and costs, including, but not limited to, attorney fees.

Contractor Duties

Under Florida law, a contractor (or anyone else) receiving rights to a claim under an AOB:

  • Must provide you with accurate and up-to-date revised estimates of the scope of work to be performed as supplemental or additional repairs are required.
  • Must perform the work in accordance with accepted industry standards.
  • May not seek payment from you exceeding the applicable deductible under the policy unless asked the contractor to perform additional work at the your own expense.
  • Must, as a condition precedent to filing suit under the policy, and, if required by the insurer, submit to examinations under oath and recorded statements conducted by the insurer or the insurer’s representative that are reasonably necessary, based on the scope of the work and the complexity of the claim, which examinations and recorded statements must be limited to matters related to the services provided, the cost of the services, and the assignment agreement.
  • Must, as a condition precedent to filing suit under the policy, and, if required by the insurer, participate in appraisal or other alternative dispute resolution methods in accordance with the terms of the policy.
  • If the contractor is making emergency repairs, the assignment of benefits cannot exceed the greater of $3,000 or 1% of your Coverage A limit.

For example, a person delinquent on $100 monthly loan payments has a wage assignment deducting the money from their paycheck and sent to the lender. Wage assignments are helpful in paying back long-term debts.

Another instance can be found in a mortgage assignment. This is where a mortgage deed gives a lender interest in a mortgaged property in return for payments received. Lenders often sell mortgages to third parties, such as other lenders. A mortgage assignment document clarifies the assignment of contract and instructs the borrower in making future mortgage payments, and potentially modifies the mortgage terms.

A final example involves a lease assignment. This benefits a relocating tenant wanting to end a lease early or a landlord looking for rent payments to pay creditors. Once the new tenant signs the lease, taking over responsibility for rent payments and other obligations, the previous tenant is released from those responsibilities. In a separate lease assignment, a landlord agrees to pay a creditor through an assignment of rent due under rental property leases. The agreement is used to pay a mortgage lender if the landlord defaults on the loan or files for bankruptcy . Any rental income would then be paid directly to the lender.

Options Assignment

Options can be assigned when a buyer decides to exercise their right to buy (or sell) stock at a particular strike price . The corresponding seller of the option is not determined when a buyer opens an option trade, but only at the time that an option holder decides to exercise their right to buy stock. So an option seller with open positions is matched with the exercising buyer via automated lottery. The randomly selected seller is then assigned to fulfill the buyer's rights. This is known as an option assignment.

Once assigned, the writer (seller) of the option will have the obligation to sell (if a call option ) or buy (if a put option ) the designated number of shares of stock at the agreed-upon price (the strike price). For instance, if the writer sold calls they would be obligated to sell the stock, and the process is often referred to as having the stock called away . For puts, the buyer of the option sells stock (puts stock shares) to the writer in the form of a short-sold position.

Suppose a trader owns 100 call options on company ABC's stock with a strike price of $10 per share. The stock is now trading at $30 and ABC is due to pay a dividend shortly. As a result, the trader exercises the options early and receives 10,000 shares of ABC paid at $10. At the same time, the other side of the long call (the short call) is assigned the contract and must deliver the shares to the long.

Return to Nature Funeral Home Owners Charged for Defrauding Clients, Defrauding Paycheck Protection Program

DENVER – The United States Attorney’s Office for the District of Colorado announces that Jon Hallford, age 44, and Carie Hallford, age 47, were indicted by a federal grand jury for allegedly defrauding their funeral home clients, and for defrauding the Paycheck Protection Program (PPP), which is part of The Coronavirus Aid, Relief, and Economic Security (CARES) Act. Both Jon and Carie Hallford each face 13 counts of wire fraud and two counts of conspiracy to commit wire fraud.

According to the indictment, the Hallfords were the co-owners of the Return to Nature Funeral Home in Penrose, Colorado. In October 2023, residents in the area reported an odor emanating from the Penrose facility.  After obtaining a search warrant, FBI investigators found 190 dead bodies inside the building in various states of decomposition.  Some of the dates on the bodies listed deaths dating back to 2019.

The indictment alleges that the Hallfords defrauded their funeral home customers by not providing a cremation or burial for the deceased as promised. 

The indictment also alleges that the Hallfords fraudulently obtained COVID-19 Relief funds on behalf of their business.    Specifically, the indictment alleges that the Hallfords provided false information to the U.S. Small Business Administration in order to obtain relief funds totaling $882,300 by misrepresenting the fact that Jon Hallford owed back child support and by claiming that their business was not engaged in criminal activity at the time they applied for COVID-19 relief funds.  The Hallfords are also accused of misapplying the relief funds for personal purposes instead of using such funds for the operation of their business. 

The Coronavirus Aid, Relief, and Economic Security (CARES) Act was enacted in March 2020 and was designed to provide emergency financial assistance to Americans dealing with the economic impact of the COVID-19 pandemic. The CARES Act created the PPP, a program administered by the SBA that provided loans to small businesses to retain workers, maintain payroll, and certain other expenses consistent with PPP rules.  Additionally, the CARES Act authorized the SBA to provide EIDLs to eligible small businesses experiencing substantial financial disruptions due to the COVID-19 pandemic.

The defendants made their initial appearances on Monday, April 15, 2024, before Judge Scott T. Varholak.  The charges contained in the indictment are allegations and the defendant is presumed innocent unless and until proven guilty.

This federal case is being investigated by the Federal Bureau of Investigation and the United States Small Business Administration Office of Inspector General.  Several other state and local law enforcement agencies including the Colorado Bureau of Investigation, the Colorado Springs Police Department, the El Paso County Coroner’s Office, the Fremont County Sheriff’s Office, and the Fremont County Coroner’s Office have made significant contributions to this case. The case is being prosecuted by Assistant United Staes Attorneys Tim Neff and Craig Fansler.

On May 17, 2021, the Attorney General established the COVID-19 Fraud Enforcement Task Force to marshal the resources of the Department of Justice in partnership with agencies across government to enhance efforts to combat and prevent pandemic-related fraud. The Task Force bolsters efforts to investigate and prosecute the most culpable domestic and international criminal actors and assists agencies tasked with administering relief programs to prevent fraud by, among other methods, augmenting and incorporating existing coordination mechanisms, identifying resources and techniques to uncover fraudulent actors and their schemes, and sharing and harnessing information and insights gained from prior enforcement efforts. On July 11, 2023, the Attorney General selected the District of Colorado’s U.S. Attorney’s Office to head one of five national COVID-19 Fraud Strike Force Teams. The Department of Justice established the Strike Force to enhance existing efforts to combat and prevent COVID-19 related financial fraud.  The Strike Force combines law enforcement and prosecutorial resources and focuses on large-scale, multistate pandemic relief fraud perpetrated by criminal organizations and transnational actors, as well as those who committed multiple instances of pandemic relief fraud. John Sterling's 10 most iconic Yankees home run calls: Alex Rodriguez, Giancarlo Stanton and more

Sterling has called it quits after 5,000 games as the voice of the yankees.

On Saturday at Yankee Stadium, the New York Yankees  honored longtime radio broadcaster John Sterling, who announced his retirement earlier this week . Sterling began broadcasting for the Yankees in 1989 and called more than 5,400 games between the regular season and postseason during his time with the club. Now 85, Sterling is ready to step away from the microphone.

"I am a very blessed human being," Sterling said in a statement. "I have been able to do what I wanted, broadcasting for 64 years. As a little boy growing up in New York as a Yankees fan, I was able to broadcast the Yankees for 36 years. It's all to my benefit, and I leave very, very happy. I look forward to seeing everyone again on Saturday."

Sterling's personalized home run calls were the soundtrack of summer for generations of Yankees fans. He had a unique home run call for every Yankee, regardless of whether it was part-time player like Eric Hinske ("Hinske with your best shot!"), a star like Aaron Judge ("All rise! Here comes the Judge!"), or a legend on his way to Cooperstown like Derek Jeter ("El Capitan!").

When the Yankees added a player in the offseason, fans spent the winter trying to guess what Sterling's home run call would be, but of course they were impossible to predict. Sterling's calls could invoke former Yankees, baseball history, pop culture, Broadway musicals, perhaps feature a little mangled Italian, you name it. It wasn't just fans who tried to guess Sterling calls either.

"We'll be sitting on the bus and we trade for somebody new or it's somebody's first game, we'd always go back and forth,'Hey, what's John going to come up with this time?'" Judge told Newsday earlier this week .

Here, in rough chronological order of when they debuted, are 10 of the best John Sterling home run calls. There were of course variations of each as the game circumstances warranted.

Bernie Williams: "Bern baby Bern!"

"Bern baby Bern" was not the first Sterling call, but for all intents and purposes, it started the craze and it withstands the test of time. Williams made his MLB debut in July 1991 and was the first late-1990s dynasty era Yankee to become a lineup mainstay. A timeless classic, this call is.

Tino Martinez: "The Bam-Tino!"

A Babe Ruth/Great Bambino pun. Sterling got plenty of mileage out of those. Jason Giambi's home run call was "The Giambino!" and for a while Sterling went with "The Sánchino!" for Gary Sanchez . Martinez authored a 44-homer season in 1997, his second in New York.

Hideki Matsui: "A thrilla from Godzilla!"

One of the greatest sluggers in Japanese baseball history, Matsui arrived in New York with much fanfare in 2003. He had picked up the nickname "Godzilla" for his prodigious power with the Yomiuri Giants, so naturally Sterling incorporated it into his home run call. General rule of thumb: You can't go wrong with a Godzilla reference.

Alex Rodriguez: "An A-bomb from A-Rod!"

Rodriguez hit 361 home runs with the Yankees between the regular season and postseason, by far the most of anyone during the Sterling era. Sterling called 5,060 consecutive games from 1989 to July 2019, so he called every single one of A-Rod's homers in pinstripes. This one goes into the record books as his most used call.

Robinson Cano: "Robbie Cano, dontcha know!"

Cool and casual, much like Sterling's broadcasting style and Cano's playing style. This is the perfect combination of player and home run call. They should all roll off the tongue this smoothly.

Johnny Damon: "Positively Damonic!"

Sterling added "He hit a Johnny rocket!" to this call and that one never got enough love as an all-time great Sterling call. The Yankees have imported more than a few Boston Red Sox outfielders over the years, including Jacoby Ellsbury ("He Ells-buries it!") and Alex Verdugo ("Alexander the Great!"), though none came to close to Damon in pinstripes, both on the field and with their Sterling call.

Brett Gardner : "Gardner plants one!"

So simple, so perfect. "Gardy goes yardy" and "It's a Gardy party" were tacked onto this call over the years. Mostly a speed and defense player throughout his career, Gardner did smack 28 home runs in 2019, the year of the dinger .

Mark Teixeira: "He sends a Tex message!"

Sterling is famously low tech. He still has a flip phone, he doesn't have a personal email account, and getting him to respond to text messages is hit or miss. For Teixeira's home run call though, Sterling went with the obvious. "You're on the Mark, Teixeira!" was the companion call here.

Gleyber Torres : "Like a good Gleyber, Torres is there!"

A play on the State Farm jingle -- "Like a good neighbor, State Farm is there!" -- Sterling also went with "It's Gleyber Day" and "He is the Gleyber of the month!" for Torres. This was among Sterling's most clever calls.

Giancarlo Stanton : "Giancarlo, non si può de stoparlo!"

This is Italian for "Giancarlo, you can't be stopped!" Stanton hit a grand slam against the Toronto Blue Jays last Sunday , in what would be Sterling's final game in booth. The grand slam was Sterling's final home run call.

There are more great Sterling calls than you could possibly count -- I've always been fond of "Downtown goes Frazier!" for Clint Frazier and "Hechavarria, mama mia!" for Adeiny Hechavarria -- and really, his most famous call is his iconic "Ballgame over! Yankees win! Thuuuuuu Yankees win!" after wins, with the length of the "Thuuuuuu" proportional to the magnitude of the win. Above all else, the man was unique. Sterling's broadcasts never lacked personality.
