Nette Neben­ein­nahmen

Dissertation, Buchbeitrag oder Fachaufsatz: Wann auch immer (angehende) Juristen etwas veröffentlichen, können sie dank der VG Wort etwas dazuverdienen. Aber wie viel und wie funktioniert es? 

Geld verdienen, ohne etwas dafür tun zu müssen? Klingt interessant und ist für alle juristischen Autoren und Autorinnen durchaus möglich – mit Hilfe der Verwertungsgesellschaft (VG) Wort. Sie ist ein Verein, in dem sich Autorinnen und Autoren sowie Verlage zur gemeinsamen Verwertung von Urheberrechten zusammengeschlossen haben. "Die Aufgabe der VG Wort besteht darin, die ihr vertraglich anvertrauten Nutzungsrechte und Vergütungsansprüche der Urheber treuhänderisch wahrzunehmen", erklärt Anette Frankenberger, Verantwortliche für die Presse- und Öffentlichkeitsarbeit. "Dies bedeutet unter anderem, eine angemessene Vergütung der Autoren und Verlage sicherzustellen."

Das Ganze funktioniert so: Die VG Wort nimmt Geld ein von denjenigen, die das geistige Eigentum anderer nutzen, beispielsweise von Bibliotheken, Schulen oder Hochschulen. Auch die Hersteller und Importeure von Kopiergeräten müssen Gelder an die Verwertungsgesellschaften abführen. Die Gelder aus den verschiedenen Einnahmequellen werden anschließend nach festgelegten Verteilungsplänen an Urheber und Verlage weitergeleitet. 

Einer, der bereits von diesen Geldern profitiert hat, ist Dr. Lukas Böffel, LL.M. (Berkeley). "Ich habe gegen Ende meines Studiums das erste Mal von einem Kollegen von der VG Wort gehört, der einen Beitrag für eine Fachzeitschrift geschrieben und sich daher dort angemeldet hat." Während der Examensvorbereitung hat Lukas Böffel, der heute im Vorstand der Berliner Rechtszeitschrift (BRZ) sitzt, in Fachzeitschriften wie der ZJS oder JA veröffentlicht und sich daher ebenfalls bei der VG Wort angemeldet. Auch während seines Promotionsstudiums kam es zu weiteren Veröffentlichungen und Meldungen, "unter anderem kleinere Teile aus meiner Promotion, die ich dann doch nicht verwendet habe, oder Themen, die über mein Promotionsthema hinausgingen".  

Einfach ausdrucken, unterschreiben, per Post einschicken 

Die Anmeldung bei der VG Wort ist einfach: "Die Urheber schließen einen Wahrnehmungsvertrag mit der VG Wort ab", erläutert Anette Frankenberger. Ein Muster des Wahrnehmungsvertrags findet sich zur Ansicht im Internet . Der Vertrag wird dann über das Online-Meldesystem T.O.M. der VG Wort abgeschlossen: einfach ausdrucken, unterschreiben und per Post einschicken. Die Anmeldung ist kostenlos.  

Mitglieder der VG Wort können sämtliche Sprachwerke melden, zum Beispiel Bücher, E-Books, einzelne Beiträge in Büchern und Zeitschriften oder Loseblattwerke. Auch wer zum Beispiel für die Berliner Rechtszeitschrift schreibt, kann seine Texte bei der Verwertungsgesellschaft melden. „Neben der Teilnahme am akademischen Diskurs, die generell im Vordergrund steht, ist es sekundär aus finanziellen Gesichtspunkten durchaus interessant, sich bei der VG Wort mit einer Publikation – etwa in der BRZ – anzumelden“, sagt Lukas Böffel. Die BRZ sei aufgrund ihres Zuschnittes gerade für Studierende eine gute Veröffentlichungsplattform. 

Dr. Stephan Schindler, wissenschaftlicher Mitarbeiter am Fachgebiet Öffentliches Recht, IT-Recht und Umweltrecht an der Universität Kassel, hat in den vergangenen Jahren sowohl Print- als auch Online-Beiträge bei der VG Wort gemeldet. "Die Meldung über das Portal T.O.M. ist einfach: In der Regel fallen juristische Veröffentlichungen unter den Bereich Wissenschaft, Online-Texte werden im Bereich METIS gemeldet", erklärt er. Der Umfang von Zeitschriften- und Buchbeiträgen muss dabei in Normseiten umgerechnet werden, eine Normseite umfasst 1.500 Zeichen. Meldefähig sind Printbeiträge ab zwei Normseiten Umfang, Online-Beiträge müssen mindestens 1.800 Anschläge lang sein. "Diese Zeichenzahl ist bei juristischen Veröffentlichungen ja schnell erreicht", sagt Stephan Schindler.  

Online-Beitrag: Bestimmte Anzahl von Lesern erforderlich 

Bei Meldungen von Internetveröffentlichungen kommt es darauf an, wo sie erschienen sind. Wenn sich der Verlag an dem Vergütungsverfahren beteiligt, müssen Autorinnen und Autoren einfach ihre VG-Wort-Karteinummer an den Verlag weitergeben, der die Meldung durchführt. Eine Voraussetzung gibt es allerdings, bevor Geld fließt: Der Online-Beitrag muss eine bestimmte Anzahl von Lesern aufweisen können. Diese Zahl wird durch sogenannte Zählpixel ermittelt, die die Website-Betreiber in die jeweiligen Beiträge einfügen müssen. "Wird der erforderliche Schwellenwert bei den Zugriffen auch in einem Folgejahr wieder erreicht, erfolgt die Ausschüttung dazu automatisch erneut", sagt Anette Frankenberger. "Hat die Website keine Zählpixel installiert, besteht noch die Möglichkeit, seinen Beitrag für die METIS-Sonderausschüttung zu melden", erklärt Stephan Schindler. Die Meldung kann jedes Jahr wiederholt werden, solange der Text im Internet präsent ist. Das Erscheinungsjahr eines Werkes ist dabei nicht von Bedeutung. 

Und was kommt nun finanziell für Texte heraus, die bei der VG Wort gemeldet werden? Das ist jedes Jahr unterschiedlich. Die Quoten schwanken und werden abhängig von der Einnahmesituation und der Anzahl der Urhebermeldungen errechnet. Die jeweils aktuellen Quoten finden sich hier . Für Beiträge in Zeitschriften oder Büchern, die im Jahr 2021 erschien sind, werden pro Normseite acht Euro ausgezahlt. Bücher mit 101 bis 300 Seiten Umfang – darunter fallen zum Beispiel Doktorarbeiten – werden im Erscheinungsjahr 2021 mit 1.600 Euro vergütet. Für einen höheren Umfang gibt es einen Zuschlag. "Auch wenn die VG-Wort-Ausschüttungen für einzelne Beiträge in der Regel nicht besonders hoch sind, kommt einiges zusammen, wenn man mehrere Beiträge im Jahr veröffentlicht", sagt Lukas Böffel. Bei einer Dissertation lohnt es sich dann auf jeden Fall: Stephan Schindler hat mit der Ausschüttung einen guten Teil der Kosten für die Publikation seiner Doktorarbeit wieder reinbekommen. "Die VG-Wort-Anmeldung kostet ja nichts außer einer Briefmarke zum Versand des Wahrnehmungsvertrags. Daher kann ich jedem, der Texte publiziert, nur dazu raten, sich dort anzumelden", sagt Schindler. Vor lauter Freude über die Ausschüttung sollte man allerdings nicht vergessen, dass VG-Wort-Einnahmen versteuert werden müssen.

Geld für Ihre Doktorarbeit von der VG Wort mitnehmen!

Unabhängig davon, ob Sie Ihre Dissertation im Eigendruck oder mit Verlagsvertrag bei einem Verlag veröffentlichen, können Sie als Autor Verwertungsansprüche bei der Verwertungsgesellschaft Wort (»VG Wort«) anmelden. Die Ausschüttung dieser Tantiemen für das Jahr 2017 (ausgezahlt in 2018) betrug für ein im Verlag veröffentlichtes Buch im Standardumfang (101 - 300 Druckseiten) 1.800 EUR! Die Beträge schwanken, waren aber bislang immer lohnenswert: Der niedrigste Wert hier verzeichnete Wert waren 350 Euro im Jahr 2007, im Jahr 2021 kamen 2.000 EUR zur Auszahlung. Für umfangreichere bzw. kürzere Werke werden Zu- bzw. Abschläge vorgenommen, für Dissertationen im Selbstverlag gibt es regelmäßig nur den halben Betrag. Voraussetzung für die erforderliche Meldung im Bereich Wissenschaften ist eine »angemessene Verbreitung des Buches in wissenschaftlichen Bibliotheken« im Sinne des jeweils aktuell geltenden Verteilungsplanes der VG Wort. Derzeit (06.10.2018) ist § 48 des Verteilungsplanes der VG Wort vom 9. Juni 2018 einschlägig:

§ 48 Ausschüttung für wissenschaftliche sowie Fach-und Sachbücher

1. Eine individuelle Ausschüttung erfolgt für wissenschaftliche sowie Fach - und Sachbücher, die in wissenschaftlichen Bibliotheken in der Bundesrepublik Deutschland in angemessenem Umfang ausgeliehen werden. Berücksichtigt werden nur Werke, die im Karlsruher Virtuellen Katalog (KVK) in mindestens zwei regionalen Verbundsystemen mit mindestens 5 Standorten nachgewiesen sind. Schenkungen werden nicht berücksichtigt.

2. Wissenschaftliche sowie Fach - und Sachbücher, bei denen die Voraussetzung von Abs. 1 nicht erfüllt ist, können nur berücksichtigt werden , sofern nachgewiesen wird, dass sie in der Bundesrepublik Deutschland in angemessenem Umfang verbreitet sind (bei mindestens 3 Standorten oder mindestens 100 verkauften Werkexemplaren) und erwartet werden kann, dass sie abgelichtet werden. Diese Werke wer den mit 50 % des regulären Urheberanteils berücksichtigt. Autobiographien werden nicht berücksichtigt.

3. Werke, die für den Unterrichtsgebrauch an Schulen bestimmt sind, sowie Werke, die zu einem erheblichen Anteil aus urheberrechtsfreien Texten oder Abbildungen bestehen, werden unter den Voraussetzungen des Abs. 1 mit 50 %, unter den Voraussetzungen des Abs. 2 mit 25 % des regulären Urheberanteils berücksichtigt.

4. Alle Werke i.S. von Abs. 1 und 2 können einmalig gemeldet werden, wenn sie im Jahr vor der Ausschüttung oder in den vorangegangenen 2 Jahren erschienen sind. Neuauflagen oder Lizenzausgaben sind nur meldefähig, wenn sie in wesentlichen Teilen neu bearbeitet sind (mindestens 10 % neuer Text). Dabei wird die Aktualisierung von Datenmaterial, die Veränderung im Druck - und Erscheinungsbild oder der Austausch von Bildmaterial nicht berücksichtigt.

5. Buchreihen und Serien, deren einzelne Bände überwiegend aus identischem Text bestehen, werden nur mit einem Band berücksichtigt. Abweichende Textteile können als Buchbeiträge gemäß den Bestimmungen des § 50 gemeldet werden.

6. Die Höhe der Vergütung richtet sich nach dem Umfang eines Buchs. Dieser ist vom Urheber auf Anforderung zu belegen. Danach werden Bücher u n abhängig von ihrem Format bewertet bei 49 bis 100 Druckseiten mit Faktor 0,7 101 bis 300 Druckseiten mit Faktor 1,0 301 bis 500 Druckseiten mit Faktor 1,1 501 bis 700 Druckseiten mit Faktor 1,2 701 bis 900 Druckseiten mit Faktor 1,3 901 bis 1.100 Druckseiten mit Faktor 1,4 über 1. 100 Druckseiten mit Faktor 1,5

7. Sammlungen von urheberrechtlich geschützten Lernkarten, die einen Mindestumfang von 101 Karten erreichen, werden mit 1/8 des vollen Buchwerts berücksichtigt.

8 . Ein Urheber kann seinen individuellen Anspruch an eine der in § 49 aufgeführten Urheberorganisationen abtreten mit der Folge, dass an diese die entsprechenden Beträge von der VG WORT auszuschütten sind.

9 . Für Beiträge in wissenschaftlichen und Fach - und Sachbüchern gelten die Bestimmungen des § 50 .

Die konkret zu verteilende Summe wird für jedes Jahr anhand der Einnahmen der VG Wort festgelegt.Für das Jahr 2020 ergab sich für ein Standard-Buch ein Betrag von 1.400 EUR. Die genauen Regelungen finden Sie am zuverlässigsten und aktuellsten unmittelbar bei der VG Wort.

Für diese Tantiemen können sich Nachteile ergeben, wenn man ein Werk sowohl elektronisch als auch gedruckt publiziert: Beide Verbreitungswege werden nämlich getrennt erfasst. Das führt natürlich dazu, dass man im Vergleich zu einem einheitlichen Vertriebsweg doppelt so viele Exemplare absetzen muss, um die jeweiligen Mindest-Verbreitungen zu erreichen. Eine Kumulierung lässt die VG Wort auch dann nicht zu, wenn es sich inhaltlich um dieselbe Arbeit handelt. Mehr zu dieser Problematik im Forum… .

Wieviel Geld gibt es genau?

Für wissenschaftliche Bücher ist der Betrag von drei Faktoren abhängig, nämlich zum einem von der Seitenzahl und zum anderen von der jeweiligen Höhe der Jahresausschüttung, außerdem davon, ob man einer Beteiligung des Verlages an der Ausschüttung zugestimmt hat oder nicht.

Der in den Quoten der Abteilung Wissenschaft festgelegte Standardbetrag (nur Autorenanteil) für ein im Jahr … erschienenes Buch gilt für ein Werk mit 101 bis 300 Druckseiten. Für größere Werke gibt es entsprechend mehr, für kleinere weniger.

Der entsprechende Wert ergibt sich jeweils aus der »Aktennotiz Hauptausschüttung« der VG Wort für das jeweilige Erscheinungs- bzw. Ausschüttungsjahr und dort aus der Rubrik 2) Abteilung Wissenschaft, A. Printmedien, a) Ausschüttung an Autoren und dort als zweiter Aufzählungspunkt »Vergütung für ein 20.. ersch. Buch«. Auf der Internetseite sind allerdings die Werte nur eine Zeitlang verfügbar, so dass ich hier versuche, ein etwas länger reichendes Archiv anzubieten (immerhin publiziert die VG Wort aber nun schon die letzten fünf Jahre).

Den großen Sprung zwischen dem Plan 2017 und dem Plan 2018 erkläre ich mir mit einem BGH-Urteil zu den Verlegeranteilen vom 21.04.2016 ( Az.I ZR 198/13 »Verlegeranteil« ) . Die waren vorher von der VG Wort "automatisch" vom Autorenanteil abgezweigt worden. Seit jener Entscheidung steht fest. dass dieses Geld grundsätzlichvollständig dem Autor zusteht und ein Verlagsanteil nur mit Zustimmung des Autors an den Verlag ausgezahlt werden darf. Weil es im Bereich Wissenschaft einen 50prozentigen Anteil geht, haben sich die Werte zwischen beiden Jahren entsprechend verdoppelt.

Darf's noch ein bißchen mehr sein?

Es gibt drei Möglichkeiten, die beschriebenen Einnahmen noch einmal etwas zu erhöhen: Einmal durch Teilnahme an der nur alle drei Jahre erfolgenden Sonderausschüttung Bibliothekstantieme und zum anderen, indem man auch weitere Texte (z.B. in Fachzeitschriften, aber auch im Internet) bei der VG Wort meldet. Und für Menschen, die vielleicht schon vor längerer Zeit veröffentlicht haben, gibt es evtl. noch nicht verteilbare Einnahmen .

Aufsätze, weitere Bücher, Texte im Internet?

Wenn man schon einmal dabei ist mit dem Melden bei der VG Wort: Auch für Aufsätze in Fachzeitschriften gibt es Geld, ebenso für Texte im Internet. Die Margen sind zwar etwas kleiner, aber warum sollte man 40 Euro, die einem zustehen, nicht auch noch mitnehmen? In Fachzeitschriften sieht Text oft so klein aus - auf den von der VG Wort herangezogenen sog. Normseiten (1.500 Schreibmaschinen-Anschläge) sieht das ganz anders aus und damit gehen auch die Quoten in die Höhe. Selbst dieser Text überschreitet das Minimum mit ca. 2.500 Zeichen schon deutlich - und in den Dateieigenschaften der üblichen Schreibprogramme lässt sich das auch fix automatisch kontrollieren.

Die Texte im Internet sind eine weitere Besonderheit. Hier muss man eigentlich schon bei der Veröffentlichung eine sog. Zählmarke (Vorpixel) in die Internetseite einbauen. Das tut nicht weh - ist aber immer dann schwierig, wenn der Seitenbetreiber das nicht unterstützt, z.B. auf Verlags-Homepages o.ä.

Für eine Übergangszeit gibt es deshalb im Bereich Texte im Internet noch die sog. Sonderausschüttung für all diejenigen, die noch keine Zählmarken einbauen können. Damit man aber überhaupt kontrollieren kann, ob der Text im fraglichen Jahr im Internet stand, muss er bis zum 31. Dezember gemeldet werden.

Einzelheiten dazu findet man auf den Internetseiten der VG Wort, die allerdings leider sehr unübersichtlich gestaltet ist.

Einkommensteuer?

Die Auszahlungen müssen übrigens in der Steuererklärung angegeben werden, es dürfte sich regelmäßig um Einnahmen aus freiberuflicher (schriftstellerischer) Tätigkeit handeln. Dafür darf man dann auch die im selben Jahr entstandenen Ausgaben in Abzug bringen. Ärgerlich oder aufwändiger wird es, wenn die Kosten - wie so oft - in früheren Jahren entstanden sind. Finanzierung der Druckkosten

Die Autorin bzw. der Autor einer Dissertation kann an der Ausschüttung der Verwertungsgesellschaft Wort partizipieren. Die Ausschüttung beträgt pro Dissertation ca. 400 Euro (Mittelwert der letzten 10 Jahre).

Autorenvertretung VG-Wort

Die VG-Wort ist ein rechtsfähiger Verein kraft Verleihung, dessen Aufgabe darin besteht, Gelder für die Nutzung von Texten einzusammeln, für welche die Berechtigten nicht anderweitig – etwa durch die Bezahlung des Kaufpreises eines Buches – bereits ein Honorar erhalten. Das, was die GEMA für Musikproduktionen ist, ist die VG-Wort für Textwerke. Immer dann, wenn in Bibliotheken entliehene Bücher auszugsweise kopiert oder wenn Kopierpapier oder Kopiergeräte verkauft werden, ist im jeweiligen Preis ein Obulus für die VG-Wort enthalten.

Zahlungen an Autoren einer Dissertation

Die eingenommenen Gelder werden, vermindert um geringfügige Verwaltungskosten, an die Berechtigten – das sind in der Regel Autoren und Verlage, die mit der VG-Wort einen Wahrnehmungsvertrag abgeschlossen haben – ausbezahlt. Durch die Vielzahl von Autoren und Verlagen, die ihre Rechte durch die VG-Wort wahrnehmen lassen, und die damit verbundene Kapitalkraft ist die VG-Wort ein ernst zu nehmender Gegner sogar für multinationale Konzerne wie etwa Google.

Anspruchsberechtigte Autoren

Anspruchsberechtigt sind Autoren wissenschaftlicher Werke, wobei der von der VG-Wort zugrunde gelegte Wissenschaftsbegriff sehr weit gefasst ist und alle Werke beinhaltet, die auf einen zielgerichteten Erkenntnisgewinn hin angelegt sind. Sogar für Sachbücher, wie z. B. einen Ratgeber zum Unterhaltsrecht, kann die Wissenschaftstantieme der VG-Wort beantragt werden. Ferner müssen die Antragsteller Deutsche im Sinne des Grundgesetzes oder Bürger der Europäischen Union sein. Autoren aus dem übrigen Ausland können die Tantieme hingegen nur beantragen, wenn sie ihren Lebensmittelpunkt dauerhaft in Deutschland haben. Ferner muss das Werk an mindestens fünf Standorten in zwei Bibliotheksverbünden nachgewiesen werden können, wobei die Pflichtstücke, die der Verlag an die Deutsche Nationalbibliothek und an die für ihn regional zuständige Landesbibliothek abliefern muss, sowie Schenkungen unberücksichtigt bleiben.

Auch Autoren, die ihre Dissertation als Privatdruck veröffentlichen, sind anspruchsberechtigt, d. h., Sie müssen nicht unbedingt den Weg über einen gewerblichen Verleger gehen, um in den Genuss der Tantieme zu kommen. Auch für reine Online-Veröffentlichungen kann man von der VG-Wort eine Tantieme erhalten. Diese fällt jedoch erheblich niedriger aus als im Printbereich.

Meldung einer Dissertation

Gemeldet werden können wissenschaftliche Werke bis zum 31. Januar des auf die Veröffentlichung folgenden Jahres, die Auszahlung erfolgt dann im Sommer des auf die Veröffentlichung folgenden Jahres. Verpasst der Autor den oben genannten Termin, so bedeutet dies nicht, dass seine Tantieme verfällt, er kann vielmehr noch in den folgenden Jahren berücksichtigt werden. Hat der Autor die Tantieme einmal erhalten, sind damit seine Ansprüche für dieses Werk abgegolten, d. h., die Zahlung erfolgt nicht jährlich wiederkehrend. Auch eventuelle Neuauflagen oder Lizenzausgaben begründen keinen erneuten Anspruch auf die Tantieme.

Kommunikation mit der VG Wort

Die Anmeldung eine Dissertation erfolgt über die Webseite der VG-Wort. Normal Is Over for Russia’s Hinterland

The ongoing protests in russia’s far east aren’t a one-off—they’re a preview of the future of the country’s periphery..

The Far Eastern Russian city of Khabarovsk, located just 19 miles from the Chinese border, was not incorporated into the Russian Empire until the mid-19th century. Imperial Russia’s control over its easternmost regions was always shaky: It’s hard to keep tabs on a place that lies thousands of miles away from the capital, across ancient forests and frozen rivers. Today, eastern Russia is poor and sparsely populated, a booming China is eager to exploit Russian lumber and other resources in the area, and the locals are restive, as evidenced by a series of major protests in Khabarovsk and neighboring cities over the past month.

Throughout Russia’s years under President Vladimir Putin, hot spots of resentment and anger have flared up now and then across the country. Protests in the provinces have tended to center on economic questions such as pensions, tariffs, and tolls, while more glamorous pro-democracy protests—the ones most likely to attract international attention—have been concentrated in Moscow. But bread-and-butter issues may have greater potential to unify a sprawling country, and more than one empire has fallen thanks to unrest in its hinterlands.

The Khabarovsk demonstrations began after the July 9 arrest of the region’s governor, Sergei Furgal, who is accused of ordering four murders in 2004 and 2005. The people of Khabarovsk were furious at the arrest, which they viewed, quite reasonably, as a Kremlin plot against democracy. Pro-Furgal memes circulated online, a petition garnered more than 30,000 signatures, and in a city of just 600,000 people, tens of thousands came out to protest. There have been daily rallies, with major demonstrations every Saturday. Chants have included slogans such as “Our vote, our Furgal” and “Putin, resign.”

Furgal didn’t set out to become an opposition hero. Before going into politics in 2005, he ran businesses that managed lumber and scrap metal, two hypercompetitive industries in the Far East that are often connected to organized crime. (Local voters are willing to excuse a checkered past.) He was elected in 2018 in a surprise victory over the United Russia incumbent, Vyacheslav Shport. Then a long-serving member of the State Duma, Furgal didn’t even bother to think up a campaign slogan for his gubernatorial run. His billboards showed only his face and name, without even stating which position he was running for. But United Russia, Putin’s party, had so angered voters with its attempts to raise the retirement age that many voted for Furgal simply because he was the candidate of the Liberal Democratic Party, which opposed the change. Furgal virtually tied with Shport in the first round. Despite reported pressure from the Kremlin to drop out, Furgal remained in the race—though he did leave town during the runoff to avoid unduly influencing the results. He won 70 percent of votes in that second round. The Kremlin punished him by changing the Far Eastern Federal District’s capital from Khabarovsk to Vladivostok, and by opening an investigation against a former governor who had supported Furgal’s campaign.

This retaliation made Furgal a “symbol of popular resistance,” according to Meduza ’s Andre y Pertsev. Furgal experimented with a new identity, joining protesters and criticizing United Russia officials. The Liberal Democratic Party swept the 2019 Khabarovsk elections, though Furgal again declined to campaign. Putin’s ratings in Khabarovsk fell, provoking further federal wrath. The authorities raided a firm linked to Furgal and arrested his ex-business partner on murder charges; the ex-partner then testified against him on murder charges from his scrap-metal career. Furgal’s days of freedom were numbered.

Wild though the Khabarovsk scrap-metal scene may have been, it seems that the charges against Furgal are bogus. An investigation by the independent paper Novaya Gazeta suggested that two of the murders of which Furgal is accused were not his doing, but were the result of a mafia conflict involving a man called “the Crab” and a food-cart business. A third charge doesn’t hold up to scrutiny, and the fourth murder, which was committed by Furgal’s driver, occurred spontaneously after a spat over a scrap-metal delivery.

So far, federal authorities have responded to the Khabarovsk protests with a mixture of soothing promises and mild punishment. Given the harsh treatment of protesters in Moscow—for instance, widespread arbitrary arrests during last summer’s protests over unfair city elections—the relatively gentle treatment of Khabarovsk marchers suggests that Moscow may find it harder or less desirable to bully citizens in far-flung places. Mikhail Degtiarev, the Liberal Democratic Party member of the State Duma who was appointed acting governor on July 20, told residents that Prime Minister Mikhail Mishustin had pledged 1.3 trillion rubles ($17.9 million) in funding for Khabarovsk. (Degtiarev has never lived in Khabarovsk and keeps leaving town during the weekend protests, to the disgust of the demonstrators .) Degtiarev also promised to create a “People’s Council” that could communicate popular demands to the governor.

Degtiarev posted on Instagram about armed and dangerous protesters and has made suggestions about foreign incitement, but he has avoided decisive action against the movement. So far, two protesters have been arrested and sentenced to weeklong jail terms for organizing unsanctioned rallies, two have been fined, and a few more have been detained before protests or attacked by unidentified men. But for the most part, the Khabarovsk police have let the marches continue unhindered. The most recent Saturday march , on Aug. 1, was the smallest so far, perhaps because of heavy rain that day. But “small” is relative: There were about 10,000 people marching.

The highest-profile protests of the Putin era thus far have been the demonstrations from 2011 to 2013 against election fraud, which centered in Moscow and included famous writers and many members of Moscow’s cosmopolitan, well-educated creative class. In response to this movement, which threatened to become a Russian version of a Ukrainian-style “color revolution,” Putin and his administration attempted to pit the Moscow and St. Petersburg creative class against the supposed silent majority of the Russian provinces. The Pussy Riot show trial, for example, was part of an effort to portray Moscow protesters as blasphemous European-style hipsters who spat on the faith of ordinary Orthodox Russians. It was easy to stimulate resentment against Moscow privilege: After all, the government had been concentrating power and wealth there since the 1990s, making the city into a top-tier glittering international capital even as the provinces languished.

But the provinces haven’t been as silent as the Russian government might like. Over the past two decades, there have been a number of significant protests outside Moscow and St. Petersburg. These have often been linked to straightforward economic grievances—in particular to falling living standards and efforts to dismantle the Soviet-style social safety net, which many Russians still consider to be a basic right. In 2005, an attempt to switch from in-kind social benefits to cash payments prompted protests in a dozen Russian cities. Demonstrators blocked highways and railways and took over government buildings. In 2008, the riot police broke up a demonstration in Vladivostok against new tariffs on imported cars; from 2009 to 2010, Kaliningrad residents demonstrated against new vehicle tariffs, and eventually against their United Russia governor and Putin. Beginning in 2015, truckers organized a strike against a new toll road system, and from 2017 to 2018 there were anti-corruption protests across the country, led by anti-corruption activist and opposition leader Alexei Navalny. Anger against the 2018 proposal to raise the retirement age was not limited to Khabarovsk; it provoked protests in most of Russia’s major cities, and contributed to several significant losses for United Russia in the 2018 elections.

As climate change accelerates, environmental questions are moving to the forefront of provincial protests. More and more Russians are demonstrating against deforestation, pollution, and government failure to prevent or control disasters such as the wildfires that now choke Siberia every summer. Last year, protesters in Krasnoyarsk demanded their governor’s resignation , furious at his statement that it didn’t make economic sense to fight the wildfires that filled the region’s air with smoke.

The Shiyes landfill protests from 2018 to 2020, in the Arkhangelsk region and the Komi Republic, have had a particularly strong metaphorical charge. When hunters discovered a secret construction site in the forest , locals learned of plans to build a new dump for Moscow’s unsorted garbage, which would have released large quantities of toxic effluvia that could have entered waterways, potentially making it all the way to the Barents Sea. Activists built roadblocks to prevent construction and established a large tent city . This protest movement, which included Indigenous activists, environmentalists, and c ommunists, had endurance: In December 2019, activists reported that a protest in Kotlas (which is, coincidentally, the birthplace of Yerofey Khabarov, the 17th-century explorer for whom Khabarovsk is named) attracted between 5,000 and 10,000 people, in a town of just 60,000. Construction halted, but activists remained on guard. In June 2020, the Arkhangelsk regional government terminated its agreement with the construction company.

Most recently, Putin caused an outcry from environmentalists when he signed a new measure, on July 31, that will open protected areas around Siberia’s Lake Baikal, the largest freshwater lake in the world and home to a unique, ancient ecosystem. Last year, locals managed to block plans to build a Chinese water bottling plant along the shores of the lake, which has long been threatened by pollution from industry, mining, and agriculture. With Russia warming about twice as fast as the rest of the world, environmental protests will most likely grow in the coming years. In a 2018 poll by the Presidential Human Rights Council, respondents said that the right most often violated by the authorities was the right to a healthy environment. (Runners-up were the rights to fair trials and elections.) As climate change continues to affect harvests, damage infrastructure (which is particularly vulnerable in areas where it was built on permafrost, which is now thawing), and contribute to natural disasters, environmental and economic concerns will converge, potentially giving rise to new protests across Siberia, the Far East, and the Arctic. The Putin administration spends much of its energy worrying about NATO and its western border, but trouble is stirring in the east and the north, too.

What would it take to turn these bursts of regional protest into a sustained national movement? Organizers will need to find problems that can unite Russians across regions and across the political spectrum. Navalny’s signature issue, the fight against corruption, has proven its enduring appeal for voters and activists of many stripes. A lack of democratic representation, falling living standards, and the erosion of the social safety net cause indignation in the metropolitan centers as well as in the provinces. Climate change still has little political currency in Russia, but concern over environmental degradation has the potential to gain national political prominence, as it did in the Soviet Union in the 1970s and 1980s. In the end, real change may be a matter of numbers: of protesters, of activists, of regions ready to take to the streets. Once the whole forest is aflame, it becomes very hard to put out the fire.

Khabarovsk: The city on the 5,000 ruble banknote

Located at the confluence of the Amur and Ussuri rivers, Khabarovsk (6140 kilometers from Moscow) is the second largest city in the Russian Far East after Vladivostok. Having grown from a small military post in the middle of the 19 th  century, the city got its name from the famous Russian explorer Yerofei Khabarov, who surveyed the Amur River. Currently Khabarovsk is the administrative center of the Far Eastern Federal District.

The city was founded by Count Nikolai Muravyov-Amursky and the main street is named in his honor. Modern buildings and shopping centers coexist with old stone houses of gray and red. A monument to this famous Russian statesman can be found in the city’s Central Park. This statue can also be seen on the 5,000-ruble banknote.

The best way to explore Khabarovsk is on foot, beginning at Lenin Square and working your way towards the banks of the Amur River. The two main boulevards, Amursky and Ussuriisky, run parallel to each other. The architecture on Lenin and Serysheva streets, with its mostly Stalin-era structures, differs from the beautiful pre-revolutionary buildings on ul. Muravieva-Amurskogo. The Amursky and Ussuriisky boulevards did not exist until the mid-1960s.

Khabarovsk is not a typical Russian city along the Trans-Siberian Railway. The unusual fusion of Russian and Chinese cultures is felt in the food, culture and even lifestyle of its residents. Japanese touches complement this picture in the form of blossoming cherry trees and cars with steering wheels on the right hand side. That Khabarovsk has such a strong Asian influence should not seem surprising, as the city is located only 17 kilometers from the state border with China. The nearest Chinese settlement, Fuyuan, is 65 kilometers down the river from Khabarovsk.

Khabarovsk’s gem is its picturesque river embankment and the Amursky rail and road bridge, which is also depicted on the 5,000-ruble banknote. Just like the Eiffel Tower, this bridge won the gold medal of the World Exhibition in Paris in the early 20 th  century.

Khabarovsk became famous during the Soviet period for a popular song about border guards that stand on the "high banks of the Amur" and protect the motherland. It is not hard to find old cannons on display in the city that were fired during the Russo-Japanese War.

At the present time Khabarovsk is the headquarters of Russia’s Far Eastern Military District.

The Military Historical Museum of the Far Eastern Military District depicts in great detail everything you ever wanted to know about the formation and development of the army in the Far East. Models of weapons from different years are exhibited over the museum’s 13 halls and heavy military equipment is placed in the courtyard of an observation deck. The museum itself is located in a historic building right on the bank of the Amur River.

The Far Eastern Art Museum, also known as the "Far East Tretyakov Gallery" features original works of ancient Russian art, as well as local artists from the Amur Region. Among the artists on display are Ivan Aivazovsky, Ivan Shishkin, Ilya Repin, Vasily Surikov, Isaak Levitan, Alexander Benois, Apollinaris Vasnetsov and Mikhail Vrubel. Many of these works of art came to the Far East from museums in Moscow and St. Petersburg.

The Khabarovsk Regional Museum holds collections of flora and fauna, ethnography exhibits of indigenous peoples and Slavic settlers, and displays by paleontologists and geologists that tell the city’s story from its foundation. The only archaeological museum in the Far East is the Okladnikov Museum, which features 120,000 ancient artifacts pertaining to the Amur Region.

For those traveling with children, Khabarovsk has special kid-friendly attractions including an aquarium featuring fresh water fish of the Amur River basin, as well as the Gaidar Amusement Park and the Khabarovsk State Circus.

A living museum of Far Eastern flora can be found at the Khabarovsk Arboretum, established as an experimental laboratory in 1896. It has collected about 300 plant species that grow in the Ussuri taiga as well as those from the Himalayas, Central Asia and North America.

Khabarovsk is known for its parks such as Dynamo or Yuri Gagarin Park. The Central Park of Culture and Relaxation is perfect for taking leisurely strolls and leads to the river station located within the park, where you can take a boat ride on the Amur River. Especially memorable is taking a walk along the river at night, when Khabarovsk is illuminated by hundreds of colored lights. In the park there is also an observation deck that offers a spectacular view of the Amur.

The oldest Orthodox Church in Khabarovsk is a Church of St. Innocentius  of Irkutsk, erected in 1870 in honor of the patron saint of Siberia and the Far East. The impressive Holy Transfiguration Cathedral (its height with golden domes is 95 meters), built from the donations of inhabitants of the region, is the third largest temple in Russia after Moscow's Christ the Savior Cathedral and St. Isaac's Cathedral in St. Petersburg.

Several major theaters operate in Khabarovsk, which is often called the cultural center of the Far East. These include the Khabarovsk Regional Musical Theater performing classic operetta and musical comedy, and the Regional Drama Theatre featuring international and domestic classics. There is also the Triad professional mime theater, which offers unusual performances in interesting interiors. 

Why you should climb the Khabarovsk cliff

Khabarovsk is hot and humid in the summer with temperatures reaching 30 C and cold and dry in the winter with the average temperature being -24 C. However, the temperatures often drop below -30, making Khabarovsk the coldest city with a population of 500,000 or more in the world. There are massive ice sculptures on Lenin Square from January until the spring thaw in April as part of the annual Amur Crystal and Ice Fantasy festivals. City Day, celebrated on the last Saturday of May, is a good reason to visit Khabarovsk at the beginning of summer.

No matter the season, if it is clear, then climb the Khabarovsk cliff (ul. Shevchenko 15), a true symbol of the city. A famous building was constructed here on a rocky promontory 70 years ago by an architect named Starikov. At first it was a station for military observation, later becoming a rescue station. After the building was transferred to Khabarovsk Central Park of Culture and Recreation, a viewing platform was added that now offers the best panoramic views of the Amur River.
